Consumers who were prescribed Suboxone could benefit from a $500,000 Federal Trade Commission (FTC) settlement over false advertising and antitrust violations.

The settlement benefits consumers who were prescribed Suboxone oral film between March 1, 2013, and Feb. 28, 2019. 

Suboxone is a medication used to treat opioid addiction, according to Drugs.com. The medication comes in a tablet and film form. 

According to the FTC, Reckitt Benckiser and Indivior conspired together to maximize Suboxone profits at the expense of consumers. In an attempt to convince more patients to take their branded medication, the companies allegedly deceived patients and doctors with claims that the film version of Suboxone was safer than tablet versions.

To secure their profits from this alleged false advertising, Reckitt Benckiser and Indivior suppressed generic competition by filing “meritless” petitions with the U.S. Food and Drug Administration (FDA), the FTC contends. These petitions reportedly repeated unsupported safety claims about the film version of Suboxone and urged the FDA to reject applications for generic tablet alternatives.

The FTC says these actions caused consumers to pay more for Suboxone when, in a healthy market, they would have otherwise been able to purchase less expensive generic versions of the medication.

In July 2020, Reckitt Benckiser agreed to a $50 million settlement to resolve these claims. Shortly after, Indivior agreed to pay $10 million to resolve the allegations.

In May 2021, the FTC distributed over $59 million to consumers who were prescribed Suboxone. Of this sum, $42 million was sent in the form of 37,212 checks while the remaining $16 million was sent as 14,663 prepaid debit cards. The 51,875 payments averaged $1,139. 

With the remaining $500,000 from the settlement fund, the FTC is distributing payments to consumers who submit a valid claim form

These payments are only available to consumers who contacted the claims administrator after the original 2021 claim deadline and asked to be put on the waitlist for payments. Consumers cannot file a claim if they did not add their name to the waitlist before September 2021, even if they otherwise qualify for payments. 

No deadline for exclusion or objection is listed on the settlement website. The Suboxone FTC settlement is not subject to final court approval.

In order to receive a payment from the Suboxone FTC settlement, consumers must submit a valid claim form by Nov. 26, 2022. To file a claim, consumers must use the ID number they received via email or mail.

    Emails from administrator seem like they don’t know what I’m asking.

      You had to have put your name on the wait list before sept 2021 after you would have to have received a email or mail with your unique ID number in order to file a claim . the mail or email have arrived by end of October this year. If you didn’t.
      Sorry maybe you can be put on another wait list after this one is paid.

    I WAS PRESCRIBED SUBOXON BY THE V.A. AND WAS ON IT FOR 2 YEARS FROM 2014 TO 2016 AND NEVER RECIVED AN ID# CAN I BE PUT ON THE WAIT LIST. THANK YOU

    I got a post card in the mail I returned it and haven’t heard anything since . I’m guessing the ones who made the original law suit just wait to hear or receive something? Also think this drug is a bandaid , that hurts like hell when you get off it. I laid on couch for 6 months afterwards and developed muscle loss and was told had hep c , got off the Suboxone and it went away. I’m cleared ..so to me this drug highly effects your liver ! I think someone should look into if others has these effects. Thanks for reading.

    I do not know how to contact the administrator to obtain my ID number . I was afraid to apply for this because of the stigma associated with addiction but willing at this point to go forward. Over 10 years of receiving tx. Would someone if possible plz reply with info as to how to contact administrator to retrieve my ID number.

    My suggestion for people asking how to get added, don’t just comment add me, look up the information for the various individuals handling the actual case and try to contact them for information. Although more than likely your just too late. The main people have already been paid and the remaining money is going to those who happened to try and file a claim right at the original deadline and were told they would be put on a waiting list, which is how they were contacted and given an id number. Really it comes down to just filing your claims at the right times before the deadlines, so try and stay up to date on the different cases going on by subscribing to this sites newsletter and constantly doing your own research. That’s how I have stayed on top of them and have been fortunate enough to qualify for quite a few cases, simply by researching and filing claims BEFORE their DEADLINES!

    I was able to ask to be out in the wait-list when I tried to sign up right after the deadline, and then I got an email with my id # and instructions on what was happening and what to do. So I filed my claim and am now waiting to on whatever payment I am eligible for?! But as far as I understand, if you are not directly tied to a case specifically, or if you don’t file a claim on your own for whatever case you think your eligible for then you won’t have any luck. My advice, subscribe to this newsletter and constantly check out class actions suits to be able to become a part of one if you end up being eligible. Other than that there are way too many people in this country for them to try and literally contact every person, which is why you really should do your own monitoring to stay aware of the ongoing cases, so that way if there comes any that you do qualify for, then you can be a part of it.
