Ron’s Staffing agreed to pay nearly $5.4 million to resolve claims it violated biometric privacy laws with fingerprint time clock systems.

The settlement benefits individuals who worked for Ron’s Staffing in Illinois and scanned their fingers between Dec. 3, 2014, and Nov. 1, 2019. There are an estimated 17,469 current and former employees included under this class definition.

Ron’s Staffing Service is a Chicago-based staffing company that specializes in solutions for light industrial businesses. Employees for Ron’s Staffing help businesses find order fillers, forklift operators, machine operators and other workers.

According to a class action lawsuit, Ron’s Staffing failed to get employee consent before scanning fingerprints for timekeeping purposes. Plaintiffs in the case say that the company’s actions violated the Illinois Biometric Information Privacy Act (BIPA).

BIPA protects Illinoisians’ biometric data including fingerprints. Under the law, companies like Ron’s Staffing are required to get consumer consent before collecting biometrics and must follow other strict guidelines. Plaintiffs in the BIPA class action lawsuit argue that Ron’s Staffing’s alleged violations of the law entitle them to thousands of dollars in damages. 

Ron’s Staffing hasn’t admitted any wrongdoing but agreed to a $5.375 million class action settlement to resolve these allegations.

Under the terms of the Ron’s Staffing fingerprint time clock settlement, class members can receive a cash payment. 

Payments are estimated to be between $350 and $750. However, exact payments may be higher or lower than this range depending on the number of claims filed with the settlement and the net settlement fund after deductions for fees, costs and plaintiff awards.

Class members have the option to receive their payments as either mailed checks or electronic payments. Class members should cash their checks within 150 days. Failure to cash a check in time will result in payment forfeiture. Of any funds that remain in the settlement after this deadline, $10,000 will be donated to Prairie State Legal Services. All other remaining funds will be returned to Ron’s Staffing’s insurer.

According to the Ron’s Staffing fingerprint time clock settlement agreement, class members received non-monetary relief in November 2019 when the company implemented BIPA-complaint practices of obtaining consent from employees who use fingerprint time clocks. The company also maintains a public BIPA policy about the deletion of data of separated employees.

The deadline for exclusion and objection is Nov. 26, 2022. 

The final approval hearing for the settlement is scheduled for Jan. 9, 2023.

In order to receive settlement benefits, class members must submit a valid claim form by Dec. 26, 2022.
