Sunrun Solar Panel Company Slapped With Class Action for Recorded Phone Messages

Solar company Sunrun is feeling the heat from consumers after being hit with a nationwide class action lawsuit alleging it repeatedly broke the law with its telephone calls.

In a class action complaint filed Tuesday in a California federal court, Plaintiff Sherry Moreno alleges Sunrun, Inc. violated the Telephone Consumer Protection Act (TCPA) when it contacted her to sell solar panels.

The TCPA is a federal law that was enacted in 1991 to protect consumers from telemarketers. It prohibits calling a cell phone number using an artificial or pre-recorded voice without the recipient’s prior express consent. 

It aims to protect consumers from unwanted marketing communications from companies via phone, cell phone, text, and fax. It also limits the use of autodialers and robocalls. This includes text messages or robocalls from energy companies.

Moreno alleges Sunrun started calling her in July 2019 with prerecorded or artificial voice messages. She says, after the calls began, she made multiple requests to Sunrun employees to stop contacting her. Despite this, her requests were allegedly ignored, and she kept receiving calls.

“This failure to stop calling is indicative of Defendant’s failure to implement a written policy for maintaining a do-not-call list and to train its personnel engaged in telemarketing on the existence and use of the do-not-call-list,” the claim states.

Moreno says she received a call as recently as January 2021. She alleges the calls have caused her harm, including invasion of privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion. 

“Defendant’s calls also inconvenienced Plaintiff and caused disruption to their daily life.”

Sunrun engages in telemarketing using pre-recorded voice calls without the proper consent, and even after recipients request to no longer receive calls, to market its solar panel systems in numerous states throughout the nation, the claim contends.

Through the class action, Moreno is seeking injunctive relief to stop Sunrun’s alleged unlawful conduct, “which has resulted in the invasion of privacy, harassment, aggravation, and disruption of the daily life of thousands of individuals.” 

She is looking to represent any United States resident sent a call using an artificial or prerecorded voice from Sunrun in the last four years. She also wants to represent a Class of people listed on the national Do Not Call Registry, a Class of people who told Sunrun not to call them again, and a Class of people who had no option to opt-out of the calls.

Moreno is seeking an order certifying the class action, damages, and injunction and a jury trial.

Meanwhile, some TCPA class action lawsuits do end in penalties for the companies. In a recent case, DISH Network was ordered to pay plaintiffs on the Do Not Call Registry who it called.

    I’m having problems getting Sunrun to remove the panels from my house the company that originally installed them was vinint solar the tricked my grandfather into signing a contract to install them. It’s been hell ever since I’ve called and ask them to just inspect them because it seem like it was a safety hazard going on with some of the wiring they didn’t even come out to do that. They constantly call my grandfather they constantly send bills for $144 and some times 30k when I ask what the 30k is for I never get an answer just put on hold and told u owe $144 for three month missed payment. I’ve asked multiple times for them to remove the panels from my house because the lied and tricked my grandfather to signing for these panels and I’ve called to have them remove because of safety hazards I can’t get anywhere with this company SUNRUN we need help with the situation . We were lied to about some many thing to many to write lied to my grandfather about the affect it would have financially and physically on the house we pay are electric through psng the panels literally are doing nothing my grandfather is 85 years old they literally tricked him into signing the papers he doesn’t know the difference between vinint solar and vinint security we had the install around the same time my grandfather doesn’t even know what he did or what he signed please help

    In last few weeks we have been getting calls from Sunrun and we didn’t ask for their help or service. How did they get our phone number? They call 3 or 4 times per day! I want them to STOP now. Maybe I ask our phone provider to block their calls.

    We finally let sun run talked to us after they came to our home and knocking on the door everyday for about a month it got so annoying I finally let them talk to me… everything they said was a lie my electric bill went up $300 a month and plus paying 150 for the panels, which do NOT produce enough electric to where we get credits which they lied… we have faulty equipment, the box on the out side is always flashing colors and they say the part is on back order but there install new systems im my neighbor hood everyday with the part I need… I absolutely hate getting solar it’s been nothing but heart ache more money and stress… sun run F***ing sucks…

      I am in the same boat! Contacted a lawyer who said they cannot help because the lease I signed says I cannot participate in a class action law suit.

    Sunrun pestered me three or four times a day for two months until I called someone in their sales office and threatened them with a lawsuit if they did not stop!

    We Are Solar contracts in Modesto, Ca we are running into many people that have went with Solar City or Sun Run, and systems are not working and solar city and sun run will not help these people even if with the 20yr contyracts. Please herlp 209 573 3040

    To whom it may concern,
    My wife and I received endless calls and then agreed to listen to them in a in home consult. After meeting with them, my wife wanted to panels so we agreed after being told that we would save money. I am blind and my wife had brain surgery. We did not receive any paperwork. and to this day I’m not ever sure where to send the $149.00 monthly payment. Is there anything that can be done?

    HELLO I HOPE IM NOT TOO LATE FOR THIS COMPLAINT. SUN RUN REPLACED SOLAR PANELS ON MY HOUSE AROUND 2015. I HAD SOLAR PANELS ON MY HOUSE ALREADY THAT WAS PAID FOR BY ME YEARS EARLIER. MY HOUSE HAD SMOKE DAMAGE FROM A SMALL FIRE AND THE CONTRACTORS DECIDED TO HAVE SUNRUN REPLACE MY SOLAR PANELS AS SUNRUN GAVE THEM MY REBATE. THE SOLAR PANELS ARE SMALL AND THE AMOUNT ADDED TO MY HOME WASNT ENOUGH EITHER. WHEN I TOLD THEM THIS. ALL THEY COULD SAY WAS THEY MAY BE SMALLER BUT THEY PRODUCE MORE ENERGY.. YEAH RIGHT I TOLD THEM. I NEVER GOT ANY PAPERWORK OR ANY TYPE OF WARRENTY ON THESE SOLAR PANELS, THEY ASKED ME FOR THE PAPERWORK ON THE ORIGINAL SOLAR PANELS I PAID FOR WHEN I GOT THEM INSTALLED PREVIOUSLY. I ASKED THEM FOR THE PAPERWORK BACK AND NEVER GOT IT. MY PG N E TRU-UP BILL LAST YEAR WAS 2,106,00 AND THIS YEAR ITS 3,221.00 . I CALLED SUN RUN FOR THEM TO CHECK OUT MY PANELS ETC,AND THEY SAID EVERYTHING IS FINE WHICH I DONT BELIEVE IS TRUE. I OWNED MY LAST ONES AND I HOPE I OWN THESE.

    Sunrun has called me 25 times in 4 days, the 2nd call I asked them to remove me and not to call me again. They continued to call. I emailed yesterday to please stop calling, they called 2 more times so far today.

    The sun run removed their solar panels from my home so I could get a new roof. They have been sitting in my driveway creating a problem for my HOA. I live on a corner lot. They refused to come move them nor cancel my contract, and It’s causing damage to the driveway. I am being fined by my HOA.

    Sunrun not only called me, they ended up selling me solar panel all on lies. Said I would get a rebate from my taxes that would almost cover the full cost of solar installafte4 3 years, didn’t happen, and Saif my property taxes (since I financed with California First) would go up what I was paying for So. Cal. Edison, again a lie. I didn’t get the paperwork until after instal was already completed, signed the documents on a tablet believing what I was being told. Please include me in any class action. Lawsuit for either of these companies
