Sunrun Solar Panel Company Slapped With Class Action for Recorded Phone Messages

Solar company Sunrun is feeling the heat from consumers after being hit with a nationwide class action lawsuit alleging it repeatedly broke the law with its telephone calls.

In a class action complaint filed Tuesday in a California federal court, Plaintiff Sherry Moreno alleges Sunrun, Inc. violated the Telephone Consumer Protection Act (TCPA) when it contacted her to sell solar panels.

The TCPA is a federal law that was enacted in 1991 to protect consumers from telemarketers. It prohibits calling a cell phone number using an artificial or pre-recorded voice without the recipient’s prior express consent. 

It aims to protect consumers from unwanted marketing communications from companies via phone, cell phone, text, and fax. It also limits the use of autodialers and robocalls. This includes text messages or robocalls from energy companies.

Moreno alleges Sunrun started calling her in July 2019 with prerecorded or artificial voice messages. She says, after the calls began, she made multiple requests to Sunrun employees to stop contacting her. Despite this, her requests were allegedly ignored, and she kept receiving calls.

“This failure to stop calling is indicative of Defendant’s failure to implement a written policy for maintaining a do-not-call list and to train its personnel engaged in telemarketing on the existence and use of the do-not-call-list,” the claim states.

Moreno says she received a call as recently as January 2021. She alleges the calls have caused her harm, including invasion of privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion. 

“Defendant’s calls also inconvenienced Plaintiff and caused disruption to their daily life.”

Sunrun engages in telemarketing using pre-recorded voice calls without the proper consent, and even after recipients request to no longer receive calls, to market its solar panel systems in numerous states throughout the nation, the claim contends.

Through the class action, Moreno is seeking injunctive relief to stop Sunrun’s alleged unlawful conduct, “which has resulted in the invasion of privacy, harassment, aggravation, and disruption of the daily life of thousands of individuals.” 

She is looking to represent any United States resident sent a call using an artificial or prerecorded voice from Sunrun in the last four years. She also wants to represent a Class of people listed on the national Do Not Call Registry, a Class of people who told Sunrun not to call them again, and a Class of people who had no option to opt-out of the calls.

Moreno is seeking an order certifying the class action, damages, and injunction and a jury trial.

Meanwhile, some TCPA class action lawsuits do end in penalties for the companies. In a recent case, DISH Network was ordered to pay plaintiffs on the Do Not Call Registry who it called.

    Please add us to the class action. We have had Sunrun since 2013. Their service is a joke. Since having the panels we have not saved any money. We pay them $203 per mont plus at the end of the year we have to pay $1,858. We had to pay for the cleaning of the panels which we were told they take care of all maintenance.

    Please help!!!

    Please add me,,,,,,I had Sunrun/Scammer since 2015,,,,,they are a joke. Customer service is horrible. I have 19 leased and 22 purchased panels on my home. They are doing what was promised. Even my electric box they replaced is not correct. There is a leak in one of my bedroom from the panels not installed right. I need serious help in dealing with these people. Can anyone help,,,,,,add me to the list. I want all these panels removed and my electrical box fixed on my house.

    I wrote a comment earlier but forgot to mention that we are trying to refinance our home and have lien our home from vivint/Sunrun who’s not putting a release so that we can refinance. We’ve been paying Sunrun a $100 a month because our systems are and haven’t been working properly since we installed their system in 2013. Our electric bill is so high that we can’t afford to pay vivint for their systems that do not workour bill. We need a lawyer to help us get this system and company off our back and roof and to also clear our bill and credit with vivint/sunrun. They have caused us so much , stress, anxiety and anger and I’m afraid that my husband having a heart problem will have a heat attack by just talking to these people.

    Vivint/Sunrun is a horrible solar company that we’ve been dealing with since 2013. Our electric bills are still high with no help from the customer service team, supervisors or technicians. Our system has never properly worked and the sales people promised us that our bill would $25 a month which never happened . It remained pretty much the same so they suggested we add more panels which would be free of charge and that our electric would be $60 a month. So they installed more panels and our bill is currently $500 to $600 a month plus $400 a month for the 2 different set of panels. We are so disappointed with ourselves for getting Vivint/Sunrun but who would expect this to happen. We want this system off our roof and need some help from someone because Vivint doesn’t do a damn thing to help ther customers. I have soo much more to say about them and my situation is exactly the same as the rest of these comments.

    We have never applied for sun run & we just received a letter that we have to pay almost $500 and if we don’t want them to deactivate our account we must pay 29k this letter has our address obviously and name. What can we do?

    SunRun is really a burglary company they steal money from people in the name of their service agreement of Lease.
    I bought a house with 2 production units, somehow one account’s autopay went off. and after 6 months they shutdown my 1 production unit without informing me and after 10 months they sent me first letter that I have past dues and they forwarding my account to third party debt collection company. However my entire house was running fine on 1 production unit. I was surprised to know that… they imposed 2 units on this house just to steal money.
    I’m keep calling them to solve my issue and explain me why no one informed me that my auto pay is not working and now after 10 months they sent me Breach notice with 8 days of deadline other wise they will take off entire unit and I need to pay them $36K. WTF is this … is this a joke. no one from their customer service to management helping me.

    I want to Sue them… they never provided a good service to me except stealing money.

      Hi Raheel . I’m experiencing the same thing. To top this off Vivint was harassing my husband about an account/contract in another state that is not at all ours. They are trying to charge us for a contract that isn’t at all ours.
      Do you have a lawyer in place? I’d like their information please .

    Sunrun installed 22 panels on my garage and they are not working due to shading from my tree and neighbors tree, as well from my house, I got slapped with Edison bill for $2300.00 and in top of that I paid my monthly bill to Sunrun. They refuse to move the panels to where they be working properly, instead I was offer a tree trim which was about 3 weeks ago and still they can’t get anybody to come out and trim the tree. I called almost everyday with no solution. I trying to find out if I can get out of the contract.

    Please add me as well. Sunrun is a corrupt company. I moved into a house that has a solar lease with Sunrun and I have been upset with them for the last year. I wish there was a way I could get their solar system off my roof!

    I have the same problem with Sunrun. When they installed the panels, 6 months later when it started to rain, the walls inside one of the rooms got wet due to their carelessness of installing their solar panels. I’m sooo fed up with them.
