Texas Transgender Youth Parent Investigation Lawsuit Overview: 

  • Who: Parents of a transgender 16-year-old girl have filed a lawsuit attempting to block the Texas Department of Family and Protective Services from being able to investigate them and other parents of trans youth. The child’s mother reportedly works at  the Texas Department of Family and Protective Services reviewing reports of abuse and neglect. 
  • Why: The investigation follows a directive given by Texas Gov. Greg Abbott, who ordered the state’s child welfare agency to investigate the parents of transgender youth after he ruled that gender-confirming care is child abuse.
  • Where: The lawsuit was filed in Texas State District Court in Travis County.

Parents of a transgender 16-year-old girl in Texas have filed a lawsuit in an attempt to stop the state from investigating them as part of a new directive by Republican Gov. Greg Abbott. 

Last month, Abbott ordered Texas’ child welfare agency to look into reports of underage youth receiving gender-confirming care, deeming it child abuse.

The trans girl’s parents, who claim they are currently under investigation by the state, are asking a judge to block the Texas Department of Family and Protective Services (DFPS) from being able to investigate them and other parents of transgender youth, the AP reports.

In addition to arguing Abbott’s directive violates their rights, the parents claim it is a violation of state law and the Texas Constitution, according to the Austin-American Statesman

While the lawsuit does not name the parents, the complaint says the mother works at DFPS reviewing reports of abuse and neglect and has been placed on leave due to the fact she has a transgender daughter, the AP reports. 

The mother claims she was told the day after being put on leave that her family was to be investigated on account of Abbott’s new directive, and that her teenage daughter is now “traumatized” by the thought of being taken from her parents. 

Gov. Abbott’s Directive Puts Psychologist In ‘Untenable Situation’ 

In addition to the parents, the plaintiff includes a licensed psychologist, which the lawsuit claims is being put in an “untenable situation” by having to risk losing her license to report to patients who receive gender-affirming care, the AP reports. 

The lawsuit is the first indication of a parent being investigated by the state since Abbott’s directive and a non-binding legal opinion filed by Texas Attorney General Ken Paxton in which he echoed Abbott’s child abuse claims. 

In his opinion, Paxton argued “sex change” procedures only serve to “permanently sterilize” minors and give “the illusion of a sex change.” 

“While you refer to these procedures as ‘sex changes,’ it is important to note that it remains medically impossible to truly change the sex of an individual because this is determined biologically at conception,” Paxton wrote.

The DFPS has said it has received three reports since Abbott’s directive, the AP reports.

    Yes, they should be investigated. 16 year olds are still children and many parents push this transgender stuff on their kids too. They should have to wait until they’re legally adults to make the final decision and go through with surgery. I’m not against transgender people in general, but I am against allowing children to have these surgeries. Teens are still figuring themselves out and should have to wait until they’re adults to give them time to really think about their decision. The brain is still basically developing too as it takes an average of 25 years to be fully developed. Parents should NOT allow children to have these surgeries.

    The Governor of Texas is an obvious bigot and exceptionally narrow minded on this and so many other things, must be the heat.

    No Texas should not be investigating these parents. While I do believe this is something that shouldn’t be started until people are fully mature adults, it’s not abuse for the parents to allow it. The parents should have their teens in therapy to help them through the process before and after. And make sure they’ve had enough time before hand to reflect and ensure it is absolutely what they want

    I agree with this. The state has a right to investigate anyone whose child is going through this change. Regardless if it’s deliberate or not not the parents should be investigated and I agree with Governor Abbott

    No they should not be investigated by If a person 16 or older wants it done then they should be allowed to be who they are.They know who they are and how they feel.
