National Republican Congressional Committee class action lawsuit overview: 

  • Who: Michael Anthony filed a class action lawsuit against the National Republican Congressional Committee (NRCC). 
  • Why: Anthony claims the NRCC violates the Telephone Consumer Protection Act by sending unsolicited text messages to consumers without their prior express consent. 
  • Where: The class action lawsuit was filed in Pennsylvania federal court. 

The National Republican Congressional Committee (NRCC) sends unlawful automated text messages to consumers without their prior express consent, a new class action alleges. 

Plaintiff Michael Anthony claims the GOP committee conducts a “wide scale telemarketing campaign that features unsolicited text message calls to consumers’ cellular telephones.” 

Anthony argues the NRCC is “fully aware that unsolicited text messages calls are being made to consumers’ cellular telephones through its own efforts and that of its agents.” 

“Defendant not only invaded the personal privacy of Plaintiff and members of the alleged Classes, but also intentionally and repeated violated the (Telephone Consumer Protection Act),” states the National Republican Congressional Committee class action. 

Anthony claims the NRCC uses an automated telephone dialing system to allegedly place the unsolicited text messages in violation of the TCPA.  

“The hardware and software used by Defendant and/or its agents has the capacity to store, produce and dial random or sequential numbers en masse, in an automated fashion,” states the National Republican Congressional Committee class action.

Anthony wants to represent a nationwide class of individuals who have received an unsolicited text message without prior express consent from the NRCC promoting its political agenda while using an automated telephone dialing system. 

In addition to accusations it violated the TCPA, the NRCC is being accused of intrusion upon seclusion, according to the National Republican Congressional Committee class action. 

Anthony demands a jury trial and requests declaratory and injunctive relief along with an award of actual and statutory damages for himself and all class members. 

A number of companies have recently been accused of violating the TCPA by sending unsolicited text messages, including Petland, Subway, Miracle-Gro and Shoe Carnival.

    I actually googled this topic in disgust today after incessant badgering thinking this must be grounds for a class action lawsuit. Texts, calls and emails never stop, despite entering STOP in texts, unsubscribing from emails (literally hundreds of each. Blocking phone numbers. Sending RNC emails asking to be removed. I literally get texts, reply stop and block them and 2 seconds later get same message from a different number. I have never seen a system so abused. A friend of mine actually changed his number because of this. I remember thinking that was extreme, but I am just about ready to do that. Imagine an organization behaving so badly that the most “sticky ” think for consumers – Their phone number – is no longer worth keeping because of this. I copied the link and am going to post it to social media. I am sure 99 percent of the people are in the same boat. I am a conservative and, at least for now, still a republican, but frankly if they don’t stop, the RNC deserves to be ruined. I have tried telling callers that the quickest way to eliminate donations is to treat people this way. I have told them repeatedly that I will NEVER EVER donate to them again

    Please include me. I will never give money to, or support, the Republican Party again secondary to this text spam harassment. It’s psyco and because I can not stop it, it borders on a form of telephone terrorism.

    You can add me. I am a republican, however the amount of texts coming in unsolicited has become extremely annoying. I’ve literally had 5 in the last hour. I typically go and block the numbers that are sending them but they have been coming in so much this last week. They just continue to send them. Just Harasssing and annoying. i want in!!

    I’ve received hundreds since last year and continue to!
    Absolutely ridiculous that we can’t just stop them. You can add me and use my phone records for your suit.

    These drive me nuts I get at least 5 daily and reply stop and keep getting them. I reached out to winter and they say “it’s not us” even though their link is on every single one. This is harassment

    I receive several unsolicited texts per day. I reply with STOP and they send more texts. I also receive 10-20 unsolicited emails per day from NRCC. I unsubscribe to all of them and they just keep sending them.

    I’ve been receiving texts from them as well. The texts used to come at least twice a day but lately have slowed down,. However I’m still receiving at minimum 3 text per week, despite countless requests for all communications to stop.
