Update:

  • A federal judge in Pennsylvania granted preliminary approval to a $28.5 million agreement to resolve claims involving a 2019 Wawa data breach. 
  • The settlement compensates financial institutions Inspire Federal Credit Union, Greater Cincinnati Credit Union and Insight Credit Union. 
  • The judge determined the settlement was “fair, reasonable and adequate” and “should effectively distribute compensation to the class members.”
  • Per the settlement, Wawa agreed to pay expenses, including notice and admin costs and attorneys fees and expenses awarded by the court. 
  • The judge previously granted approval of a $12 million settlement agreement between Wawa and a group of customers whose information was exposed in the data breach.

Wawa employees are continuing to object to a $12 million settlement reached between their employer and customers whose payment information may have been exposed in a data breach. 

Employees have asked a federal court in Pennsylvania to ensure that the settlement does not affect their own additional claims against the company in response to the incident. 

The settlement will give customers who were potentially affected by the data breach will be automatically notified by email or the Wawa app and given gift cards ranging from $5 to $15, the settlement states.

Customers could also be eligible for up to $500 in compensation for any out-of-pocket expenses they had to endure following the incident.

The employees are concerned, however, that because some of them made purchases at the store while during their shifts, additional claims they have made could be released due to the customer settlement. 

“Employee plaintiffs renew their objections to the consumer plaintiffs’ proposed class settlement with Wawa to the extent they seek to compromise the rights of the putative class of Wawa employees in this case separately represented by the undersigned counsel,” employees said.

The class action lawsuits stem from an alleged malware breach of Wawa’s computer systems in 2019, exposing payment data from transactions made at gas pumps and cash registers. 

Complaints against the company were separated into classes of employees, customers, and financial institutions that were affected by the incident. 

As part of its settlement agreement, Wawa has also promised to make $35 million worth of security upgrades to its point-of-sale systems.

Workers, however, also objected to this part of the settlement, arguing it failed to address potential security concerns with other Wawa computer systems containing their sensitive private data. 

Last month, Wawa was part of a group of restaurant and retail chains that decided to drop allegations of price fixing against pork producer JBS USA Food Co. following settlements worth more than $50 million.

    My information was exposed in the Wawa data breach. I was trying to use my coral community credit union bank card and it kept on declining. I called the credit union and the sent me a replacement card because of the data breach caused by Wawa. Add me please. Thank you.
