Quest Data Breach Leads to Class Action Lawsuit

Quest Diagnostics was hit with class action lawsuit by a patient who says that he was affected by the recent data breach.

The security breach occurred at the American Medical Collection Agency (AMCA), which is the contracted collections agency for Quest Diagnostics, a medical laboratory service company. Quest Diagnostics, Optum360, and AMCA are the named defendants in this Quest data breach class action lawsuit. LabCorp patients were affected by the same breach.

The lawsuit was also filed in the U.S. District Court for the District of New Jersey by plaintiff Julio V. of California. He believes that Quest Diagnostics failed in their duty to protect the Personally Identifiable Information (PII) and Payment Card Data (PCD) of himself and other class members affected by the data breach.

The allegations in this Quest lawsuit include negligence, breach of contract, unjust enrichment, unlawful, unfair, and fraudulent business practices under the California unfair competition law, Violation of the California Confidentiality of Medical Information Act, and Violation of the New Jersey Consumer Fraud Act.

The information believed to be compromised by the Quest data breach includes:

• Names
• Mailing addresses
• Email addresses
• Dates of birth
• Telephone numbers
• Gener
• Credit and debit card data
• Bank account numbers
• Private medical information.

While Quest said at the time of the breach that it couldn’t ascertain the truth of the type of information leaked, AMCA claimed that 11.9 million Quest customers had stored data on the system that was hacked.

Release of Medical Information Poses Unique Concerns

While any data breach involving personal data and payment information has very volatile concerns attached with it, the release of private medical information comes with unique fears to those caught up in this breach.

According to the USA Today, among those fears are threats of vulnerability to being denied health insurance due to pre-existing conditions.

Many patients already have health insurance offered through their employers, but a change in an employment situation might make them vulnerable.

Phishing attacks can be targeted toward people much more easily the more information is known about them. Phishing is email communications designed to look like a legitimate website whereby money is extorted for false products.

A second lawsuit has been filed over the Quest data breach making similar allegations, according to Forbes.

That data breach class action lawsuit was filed in the same New Jersey federal court by a Florida patient of Quest Diagnostics. The Florida plaintiff is seeking $5 million in damages for herself and the other 12 million people affected by the massive medical data breach.
