Physicians Business Office data breach class action lawsuit overview:

Physician’s Business Office failed to properly secure and safeguard the protected health and personally identifiable information of individuals in its systems during a data breach discovered earlier this year, a new class action lawsuit alleges.
Plaintiff Hunter Freeland claims a data breach affecting Physician’s Business Office exposed information such as full names, home addresses, Social Security Numbers, and medical treatment and diagnosis info, among other things.
Freeland argues Physician’s Business Office is responsible for the data breach—which he says affected nearly 200,000 consumers—due to its allegedly “inadequately protected network servers.”
“With this action, Representative Plaintiff seeks to hold Defendant responsible for the harms it caused and will continue to cause Representative Plaintiff and at least 196,573 other similarly situated persons,” states the Physician Business Office class action.
Freeland wants to represent a nationwide class and West Virginia subclass of individuals who had their personal health or identifiable information exposed by an unauthorized third party during the Physician’s Business Office data breach.
Physician’s Business Office accused of waiting months to disclose data breach
Physician’s Business Office waited until September to inform the public about the data breach, despite it allegedly discovering that it occurred in April, the Physician’s Business Office class action alleges.
Freeland claims Physician’s Business Office is guilty of negligence, unjust enrichment, breach of confidence, and invasion of privacy, among other things.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, consequential, and nominal damages for himself and all class members.
In August, Novant Health sent 1.3 million notification letters to its patients warning them that their private health information may have been given to Meta through a tracking tool linked back to Facebook.
