Mount Saint Mary College failed to protect personally identifiable information belonging to its current and former students, employees, and applicants for admission or employment, during a December 2022 data breach, a new class action lawsuit alleges.
Plaintiff Markayla Fernandes claims Mount Saint Mary College failed to properly protect and safeguard information given to it by approximately 17,000 individuals who attempted to either enroll or be eligible for employment with the school.
Fernandes argues the college retained the personally identifiable information for “at least many years and even after the relationship has ended,” yet allegedly declined to take measures that would protect it from being compromised in the data breach.
“Defendant failed to adequately protect Plaintiff’s and Class Members (personally identifiable information) –– and failed to even encrypt or redact this highly sensitive information,”
Fernandes wants to represent a nationwide class of individuals who had their information compromised in the data breach announced by Mount Saint Mary College on or about Feb. 7, 2023.
Mount Saint Mary College data breach exposed Social Security numbers, full names, other sensitive info, class action says
Information compromised in the data breach includes birthdates, full names, Social Security numbers, email addresses, passport numbers, among other things, the Mount Saint Mary College class action alleges.
“Defendant assumed legal and equitable duties to those individuals to protect and safeguard that information from unauthorized access and intrusion,” the Mount Saint Mary College class action states.
Fernandes claims Mount Saint Mary College is guilty of negligence, unjust enrichment, and breach of implied contract, and of violating New York General Business Law.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, statutory, nominal, and consequential damages for herself and all class members.
A similar class action lawsuit was filed against Hope College in January by an individual arguing the school failed to prevent sensitive data belonging to students, applicants, contractors and employees from being compromised in a 2022 cyberattack.
