Harvard Pilgrim class action overview: 

  • Who: Plaintiffs Jacqueline Vorpahl, Kai Vorpahl and Katie McGuire filed a class action lawsuit against Harvard Pilgrim Health Care Inc., HPHC Insurance Company Inc. and Point32Health Inc.

Plaintiffs Jacqueline Vorpahl, Kai Vorpahl and Katie McGuire filed a class action lawsuit against Harvard Pilgrim Health Care Inc., HPHC Insurance Company Inc. and Point32Health Inc., claiming they failed to secure patients’ personal medical information from a data breach.

The companies did not take the steps necessary to prevent the breach and also did not fully inform patients of the amount of personal information that was stolen, the Harvard Pilgrim class action states.

“Defendants abdicated their obligations and duties to protect sensitive personal information in their possession … and failed to take steps necessary to prevent such an attack and have refused to date to fully and adequately notify victims of this attack that their personal information was improperly accessed and stolen as a result of such an attack and provide appropriate relief,” the Harvard Pilgrim class action states.

Class contains 2.5M+ patients over 10+ years, Harvard Pilgrim class action says

More than 2.5 million patients received notification of the Harvard Pilgrim data breach in April 2023, according to the class action. The class includes more than 10 years of Harvard Pilgrim members – from March 28, 2012, to April 17, 2023 – or those whose physician or provider contracts with Harvard Pilgrim.

The class seeks an injunction, declaratory relief, compensation, damages and legal fees, according to court documents.

Data breaches in the health care sector are all too common. 

In June, Comprehensive Health Services, now known as Acuity, agreed to a settlement after hackers allegedly stole the personal identifying information of 106,910 individuals. The class received up to $500 for out-of-pocket expenses including bank fees, credit expenses and three hours of lost time at a rate of $20 per hour.
