Nearly 2.5 million individuals may be affected by a recent cyberattack in which unauthorized criminals accessed sensitive data from Enzo Biochem, according to a class action lawsuit filed  June 26 in New York federal court.

Plaintiff Paula Magnani filed the class action lawsuit on behalf of herself and others whose information was compromised in the Enzo Biochem data breach.

Enzo Biochem is a New York-based life sciences and biotechnology company, and its wholly-owned subsidiary Enzo Clinical is a full-service clinical reference laboratory, Magnani explains.

The personally identifying information (PII) and protected health information (PHI) that may have been compromised in the Enzo Biochem data breach included names, clinical health information, dates of service, and Social Security numbers.

The data breach class action lawsuit notes that Enzo Biochem is a HIPAA covered entity and is thus required to implement safeguards to prevent the unauthorized disclosure or use of private information and to report any unauthorized use or disclosure of the private information. 

Magnani says Enzo Biochem maintained class members’ PII and PHI “in a negligent and/or reckless manner,” leaving the information stored on its computer system and network “in a condition vulnerable to cyberattacks.”

To make matters worse, the Enzo Biochem class action lawsuit alleges the defendants waited nearly two months to notify affected individuals after they learned about the cyberattack and data breach, preventing class members from taking quick action to protect their sensitive information.

Magnani notes that data thieves can use the information obtained in the Enzo Biochem data breach to commit a number of crimes in the class members’ names, including opening new financial accounts, taking out loans, obtaining medical services, filing fraudulent tax returns, and obtaining driver’s licenses.

Due to the Enzo Biochem data breach, Magnani says that she and the other putative class members “face a substantial risk of imminent and certainly impending harm.”

The Enzo Biochem class action lawsuit asserts claims for negligence, breach of implied contract, unjust enrichment, breach of fiduciary duty, and bailment.

Earlier this month, Verizon Wireless released its 2023 Data Breach Investigations Report, which found that human error plays a significant role in ransomware attacks and data breaches, which are becoming more frequent and costly.

    I received a letter on May 31, 2023 informing me that in April 2023 my files and personal information were breached. The letter stated “The files contained your name, date of service, and clinical test information”. I called the Enzo response line at least three separate dates but they did not answer any of my questions. They just read what was in the letter. I asked that a supervisor contact me. As of September 25, 2023 no one has called me back. I am very upset that my private clinical test information was compromised/taken. I would like more information joining the class action suit against Enzo. Enzo has clearly given me the run-around and has not been supportive regarding this breach.

    I just received a letter from Enzo Clinical Lab that the files containing my name, date of service and clinical tests information was identified in a ransomware incident on their computer network.
