A Planet Nissan settlement resolves claims the auto dealer failed to protect customers from a 2022 data breach.
The Planet Nissan settlement benefits individuals who received a data breach notice from Planet Nissan informing them their information may have been affected by a data breach in June 2022.
According to the class action lawsuit, Planet Nissan should have implemented reasonable cybersecurity measures to protect consumer information from a data breach in June 2022. This cyberattack allegedly compromised about 1,000 consumers’ sensitive information.Â
JS Autoworld, doing business as Planet Nissan, is a Nissan dealer in Las Vegas.
Planet Nissan hasn’t admitted wrongdoing but agreed to pay an undisclosed sum to resolve the class action lawsuit.
Under the terms of the Planet Nissan settlement, class members can receive up to $500 for ordinary losses related to the data breach, such as unreimbursed bank fees, communication charges, credit expenses, travel costs and up to four hours of lost time compensated at a rate of $17.50 per hour if the class member spent at least one full hour dealing with the data breach. These losses must have been incurred between June 30, 2022, and July 1, 2024.
Class members who experienced documented extraordinary data breach losses, such as documented monetary damages stemming from fraud or identity theft, can receive larger payments of up to $4,750. The claimant must have made reasonable efforts to avoid or seek reimbursement for the loss, which must have occurred between June 30, 2022, and July 1, 2024
All class members submitting a valid claim form are eligible to receive years of free credit monitoring services with $1,000,000 in identity theft insurance.
In addition, Planet Nissan has enhanced security for class members’ personal information.
The deadline for exclusion and objection is May 31, 2024.
The final approval hearing for the Planet Nissan settlement is scheduled for July 17, 2024.
Class members must submit a valid claim form by July 1, 2024, to receive settlement benefits.
