OneMain Financial class action lawsuit overview:

A new class action lawsuit claims OneMain Financial failed to secure the sensitive and personally identifiable information (PII) of customers affected by a data breach.
Plaintiff Cari Fedorchak, a Pennsylvania resident and OneMain Financial customer, claims she was required to provide her private information to the company as a condition of receiving its services.
OneMain Financial offers secured and unsecured personal installment loans to borrowers with below-average or fair-to-bad credit. The company filed a notice of public disclosure about the breach on Sept. 25, 2026, according to the complaint.
Fedorchak claims OneMain Financial did not use reasonable security practices, such as encrypting customer data or deleting it when it was no longer needed. She alleges unauthorized third parties accessed and acquired files containing unencrypted names, addresses and Social Security numbers.
She also argues the company failed to properly monitor its computer network and systems and did not promptly notify affected customers, delaying their ability to protect themselves. “Had [the] defendant properly monitored its IT network, it would have discovered the breach sooner,” the OneMain Financial class action lawsuit says.
Fedorchak wants to represent a nationwide class of all individuals whose private information was accessed or acquired by an unauthorized party in the OneMain Financial data breach. The complaint estimates that the class includes thousands of members, if not more.
OneMain Financial data breach puts customers at risk of identity theft, lawsuit claims
Fedorchak argues she and other class members now face an increased risk of identity theft and fraud for years to come. She claims, based on information and belief, that her stolen information was likely published on the dark web, where criminals buy and sell personal data.
The class action lawsuit claims data thieves could use information exposed in the OneMain Financial data breach to open financial accounts, take out loans and file fraudulent tax returns in class members’ names.
Fedorchak says she has already spent several hours reviewing her bank accounts, monitoring her credit report and changing her passwords.
The class action lawsuit claims OneMain Financial is guilty of negligence, negligence per se, breach of implied contract and unjust enrichment.
The plaintiff demands a jury trial and requests damages, restitution and injunctive relief, including stronger data security, periodic audits, and lifetime credit monitoring and identity theft insurance for class members.
