Dish Network Corp. is facing a class action lawsuit alleging it failed to safeguard customers’ and employees’ personal information from hackers.

Plaintiff Susan Owen-Brooks says she was notified last month about a Dish Network data breach in which the personal information of the satellite television provider’s customers and employees was compromised.

News reports indicated the Dish Network data breach was actually a ransomware attack from a Russian ransomware gang called Black Basta, Owens-Brooks says, which accessed the data on Feb. 23.

The hackers reportedly accessed customer and employee names, birthdates, addresses, email addresses, Social Security numbers, driver’s license numbers, credit card or account information and other personally identifiable information (PII).

With this PII, the Dish Network class action notes, cybercriminals are able to commit a number of crimes in the victims’ names, such as opening new financial accounts, taking out loans, obtaining medical services, obtaining government benefits, filing fraudulent tax returns and giving false information to police during arrest.

Plaintiff: Dish Network data breach increases risk of identity theft, fraud

Owen-Brooks says the putative class members’ identities are at risk due to the Dish Network data breach, and seeks compensatory damages, reimbursement of out-of-pocket costs and injunctive relief on behalf of herself and the proposed class.

The Dish Network class action notes that the company’s privacy policy assures customers that it will not share PII with third parties except in specific, defined circumstances and that it takes information security seriously.

However, Owen-Brooks says Dish Network failed to comply with industry standards and left its customer and employee data vulnerable to cybercriminals. 

She notes the high market value of PII and the substantial risk of prison time for cyber theft to stress the importance of information security, and that there is high probability that the information stolen in the Dish Network data breach will be “dumped on the black market,” putting class members at increased risk of fraud and identity theft.

The Dish Network class action lawsuit asserts claims for negligence, breach of contract, breach of implied contract, unjust enrichment, and violation of the North Carolina Deceptive Trade Practices Act.

In 2021, Dish Network agreed to a settlement over claims it made telemarketing calls to phone numbers listed on the National Do Not Call Registry in violation of the Telephone Consumer Protection Act.

    I had dish when the data breach happened. I couldn’t contact anybody to pay my bill and eventually the shut my satellite off, when they Said they wouldn’t and kept charging me.

    I worked for DISH for more than 18 months, received the same letter. Interestingly enough, I did a small stint supporting their IT Security division (no I was not responsible for this side of things). I am not surprised that they had a breach, and this is definitely not the only one that has happened. Would love to help others like myself that had their info leaked.

    Worked for dish 3 Years, left the company years ago. Received a letter from them stating my employee information was stolen, SS# ,DOB info, phone numbers, this info should have been destroyed after i left this company, They should be held accountable. No Excuse

      They knew employees information was compromised before they even let their employees know. They forced employees to sign a arbitration agreement before letting employees know. They threaten employees to sign this arbitration or lose your job. This is illegal . They wanted you to sign within five minutes pages and pages of legal arbitration agreements. These employees were forced to sign it! Look into that . Dish didn’t prevent or care to even at this point that current employees and former employees info and family info is leaked. My kids social birthdates included. All employees need to get this lawsuit.

      I received the same letter, and although my employment with Dish was just over six months, I was on the front lines reading they’re less than truthful press releases. In addition, my drivers license information has been used. I am trying to get my drivers license reinstated but I have lost two jobs to the false information given by whoever used my drivers license number and I’m just now starting to dive in if I was. For another job who knows when I would’ve found out about my license as it is, I can’t make ends meet I don’t have any means to take care of these problems just stress and aggravation and a lot of anger at Dish Network. And I just like to add that Dish interviewed and recruited me. I quit a job that I’ve had for almost 2 years to go to work for Dish who I have been trying to go to work for for two decades I can’t describe my disappointment.

        Hey y’all did you leave Boost Mobile and found out that they charge you even though you’re still not a customer no more try five times won’t give my money back so look at your bank statements oh one more thing if you don’t sign up for auto payment the computer picture on it anyway I didn’t authorize it computer decided to authorize auto payment not cool booth Stole My Money try five times to get it back got text messages saying you took it bank statement said you took it but you said you don’t got it time to stop the company for taking advantage of people this hard times out here

    I am runing into the same kind of problem. Had dish installed on feb 19 2023 and never had service untill I was able to cancel dish by the way of an email post that I found on the internet. Finally I found the post because from the time I got back from the hospital till that posting I could never get ahold of anyone at Dish net work. None of their phone service would answer calls. Now I’m seeing a $440.00 charge against my checking account. And lately I’ve spent over 3 hours on the phone trying to get my money refunded. The last rep finally put in a case file . It remains to be seen if any thing will become of that. There needs to be a class action suit aginst Dish for customers that are being charged for something that Dish wasn’t supplying. Hopefully

    My dish network was to shut off I was unable to call them. This is when the data breach happened I was unable to call them for over a month. when I finally did get ahold of them I had been charged twice out of my bank account in same day then they said that didn’t happen I told them I had my bank statement 2 prove it they continue to charge me for service I didn’t even have

    Since the break of Security on match 23. I try to close my account with Dish. They refuse to close my account. I complain with the FCC better business bureau. My data was compromised, they refuse to cancel my account and continue to bill me. My account was close 2 month after my initial request because the better business bureau was involved. Dish never offer a plan to guard my personal data. Will like to join a class action again Dish Network.
