 Navistar Data Breach Class Action Lawsuit Overview:

Navistar’s inadequate and reckless safeguarding of employees’ private information made it vulnerable to a May cyberattack that exposed tens of thousands of current and former employee’s data, a new class action lawsuit alleges.

The lawsuit was filed in Illinois on Friday by lead plaintiffs Thomas and Cherrie Kalbrier, both former employees of the company. The plaintiffs allege that the potential for a breach was a known and foreseeable risk to Navistar. They say the company was on notice that failing to take steps necessary to secure the private information left that data exposed to cyber criminals.

Navistar Data Breach Exposes Thousands

In May, Navistar was the target of a cyber-attack that allowed a third party to access Navistar’s computer systems and data, resulting in the compromise of highly sensitive personal information belonging to tens of thousands of current and former employees and their family members, the lawsuit alleges.

Names, Social Security numbers, driver’s license numbers, and medical information were all accessed in the breach, resulting in the former and current employees experiencing the risk of fraud and identity theft, lost value of their private and confidential information, out-of-pocket expenses, and the value of their time reasonably incurred to remedy or mitigate the effects of the attack, the Kalbriers claim.

In addition to its data mismanagement, Navistar also failed to detect the breach for more than a week and failed to warn those affected for months.

“Plaintiffs’ and Class Members’ identities are now at risk because of Defendant’s negligent conduct since the Private Information that Defendant collected and maintained is now in the hands of data thieves,” the Navistar lawsuit alleges.

It adds that data thieves could use the data to open bank accounts; take out loans; get government benefits; file fraudulent tax returns; and more.

“As a further result of the Cyber-Attack, Plaintiffs and Class Members have been exposed to a substantial and present risk of fraud and identity theft,” the claim alleges.

“Plaintiffs and Class Members must now and in the future closely monitor their financial accounts to guard against identity theft…incur out of pocket costs for, e.g., purchasing credit monitoring services, credit freezes, credit reports, or other protective measures to deter and detect identity theft.”

The Kalbriers want to represent anyone whose data was compromised during the data breach. They are suing for negligence and breach of implied contract and seek certification of the Class, compensatory damages, nominal damages, reimbursement of out-of-pocket costs, and injunctive relief including improvements to Navistar’s data security systems, future annual audits, and adequate credit monitoring services.

    I believe I may have been compromised. Two Visa credit cards were affected. The first was on or around 6/25/2021, and the replacement was affected on or around 7/13/2021. The first breach caused many hours of phone time advising those companies where I auto-pay utilities, insurance, other credit cards, of the breach. The second was while my husband was traveling, and I was forced to cancel the card, leaving him with trying to explain to the hotels, etc. where he had reservations, why he was forced to use a different card from the one the reservations were made with. Fortunately he had another cards to use, but was left feeling very uncomfortable while the other card was verified.

    I had to report my bank card stolen cause someone made 3 purchases that wasnt me, I had my bank info hacked, it was such a pain being on the phone very time consuming. Had a few weird phone calls also about my medical.
