Elekta Data Breach Class Action Lawsuit Overview: 

  • Who: Elekta, a medical software provider, has been hit with a class action lawsuit alleging negligence.
  • What: Plaintiff Deborah Harrington alleges the company allowed cybercriminals to copy the personal information of hundreds of thousands of patients undergoing cancer treatment during a ransomware attack.
  • Where: The lawsuit is for anyone in the U.S. whose data was accessed in the ransomware attack.

Elekta, a medical software provider, allowed cybercriminals to copy the personal information of hundreds of thousands of patients undergoing cancer treatment at hospitals nationwide by failing to protect their personal data, a new class action lawsuit alleges.

The lawsuit was filed in Atlanta on September 28 by lead plaintiff Deborah Harrington who alleges that the company failed to safeguard and protect patients’ confidential information — including names, dates of birth, Social Security Numbers, health insurance information, medical record numbers, and clinical information related to treatment, which it had assured was well protected.

“Elekta did not have sufficient cyber-security procedures and policies in place to safeguard the Sensitive Information it possessed,” Harrington argues, adding that because of that cybercriminals were able to gain access to Elekta’s systems between April 2 and April 20, 2021, as part of a ransomware attack.

Elekta Data Breach Exposes More Than 200K Cancer Patients’ Info

Harrington is a former patient of Northwestern Memorial HealthCare, where at least 201,196 other patients had their personal data accessed, she alleges.

Harrington says in the claim that the patients have suffered harm that includes the imminent risk of future identity theft; lost time and money spent to mitigate the threat of identity theft; diminished value of personal information; and a loss of privacy.

“Plaintiff and all members of the proposed Class are and will continue to be at imminent risk for tax fraud and identity theft and the attendant dangers thereof for the rest of their lives because their Sensitive Information, including Social Security Numbers and healthcare information, is in the hands of cybercriminals,” the Elekta data breach lawsuit states.

Harrington wants to represent anyone whose data was accessed as part of the Elekta data breach. She is suing for negligence and intrusion upon seclusion/invasion of privacy and seeks certification of the Class, injunctive relief, damages, interest, legal fees and costs, and a jury trial.

Companies often face lawsuits for not adequately protecting consumers’ personal information. Currently, T-Mobile is facing a slew of class action lawsuits over a data breach in August where the personal information of more than 100 million customers was potentially exposed.
