Bissell class action lawsuit overview:

  • Who: Plaintiff Pearl Talbot has filed a class action lawsuit against Bissell Homecare Inc.

Bissell Homecare Inc. is facing a class action lawsuit alleging that some of its vacuums have a defect that causes them to overheat, smoke, and potentially catch fire.

Plaintiff Pearl Talbot says she purchased a Bissell Cordless Multi-Surface Wet Dry Vacuum Model 22519 in 2021 or 2022. Before purchasing the vacuum, she reviewed the product labels and disclosures and believed that the Bissell vacuums were safe and effective to use, the Bissell class action lawsuit states.

However, the vacuum label did not provide a warning or other notice about the allegedly dangerous defect, Talbot alleges. If she had known about the Bissell vacuums defect, Talbot says she would not have purchased the vacuum or would not have paid as much for it.

On Jan. 12, Bissell recalled more than 65,000 vacuums because they can overheat and pose a fire risk.

Talbot filed the Bissell class action lawsuit on behalf of herself and other consumers in the United States who purchased Bissell vacuums with the following model numbers: 2551, 2551W, and 25519.

Bissell failed to ensure safety of its vacuums, Bissell class action alleges

“For nearly 150 years, Bissell has undoubtedly built itself up as a brand consumers trust and rely on when purchasing vacuums,” the Bissell class action lawsuit states. 

“Despite this longstanding history and promises made to consumers that using its vacuums leads to peace of mind, Bissell has failed to ensure the basic safety of its vacuums.”

Talbot notes that the Bissell vacuums are sold for about $360 while comparable vacuums are sold for $100 or less. Bissell is able to charge a premium for its vacuums because of its long-standing reputation, the Bissell class action lawsuit alleges.

Talbot claims the Bissell vacuums have faulty battery systems, circuit boards, and/or other faulty electronic components that cause the alleged defect.

Bissell makes multiple representations about the safety and effectiveness of its vacuums without disclosing that they pose a potential safety risk, Talbot says. However, the company allegedly knew or should have known that the vacuums were defective and unsafe yet continued to sell the defective vacuums.
