Abbott Laboratories shared patients’ medical information without their consent, according to a class action filed Dec. 28 in California federal court.
Abbott Laboratories is involved in the discovery, development, manufacture and sale of health care products, the Abbott class action lawsuit explains. The company’s sales team works with medical facilities and doctors to recommend and prescribe Abbott products.
Hundreds of patients received email with other patients’ medical data, Abbott class action says
Plaintiff DJ Glenon says he is a patient of a medical group that works with Abbott Laboratories. In October 2022, the medical group reportedly sent Abbott a patient list for joint marketing purposes. An agent of Abbott subsequently sent an email to patients on the list with information about other medical group patients, according to the Abbott data class action.
The email reportedly included the names, email addresses and patient status of the group. Additionally, the email allegedly contained information such as medical conditions, treatments, devices, therapies, doctors’ names and results.
Glenon says Abbott sent the email to himself and hundreds of other patients. In December 2022, the company reportedly sent a letter notifying him about the Abbott data breach.
“Plaintiff was surprised that the Medical Group disclosed his information to [Abbott], but he was even more shocked, upset and embarrassed that [Abbott] disclosed his medical information to hundreds of strangers,” the Abbott class action lawsuit says.
Abbott data class action says those affected are entitled to compensation
The Abbott data breach class action lawsuit asserts claims for violations of the Confidentiality of Medical Information Act (CMIA), a California law that prohibits the disclosure of medical information without consent. The CMIA provides statutory damages of $1,000 per violation.
Glenon filed the Abbott class action lawsuit on behalf of himself and a proposed class of people in California who were sent a letter on behalf of the medical group titled “Notice of Data Breach” on or about Dec. 7, 2022.
In related news, a consumer recently hit Abbott Laboratories with a class action lawsuit alleging it failed to warn consumers about bacteria contamination in some of its powdered baby formula products.

My husband has a RECALL on his Nerve stimulator and I have to find an attorney to help him. I have records of ALL the problems this is causing him including shocking and burning on inside, and causing him to drag his feet when he walks and he has to keep turning it on and off so he is trading one type of pain for another every time he has to turn the device off or on. I would like to have an attorney get a hold of me to figure out his next move. The doctor that put it in didn’t even do it right. I am not having him be used as a pin fusion anymore. Are they sure this was only in California? I am concerned because I have an ABBOT interstim implanted in my hip. I have already had my identify stolen once in the summer and do not want to ever face a mess like this again.
