Experian credit reporting class action settlement overview:

  • Who: Experian has agreed to a $22.45 million class action settlement with consumers.
  • Why: The class action settlement was made to resolve claims Experian harmed consumers’ ability to obtain credit by putting out credit reports that contained inaccurate and/or obsolete information.
  • Where: The class action lawsuit was filed in Virginia federal court.

Experian has agreed to pay $22.45 million to resolve claims it hurt consumers’ ability to get credit by adding allegedly inaccurate and untrue information to their credit reports.

The consumer credit reporting company also agreed to a settlement which will compensate tens of millions of individuals whose addresses Experian inaccurately flagged as being high risk or non-residential.

Plaintiff Lisa Hill-Green accused Experian in September 2019 of making her a credit report which used an outdated home address with incorrect information to report it as high-risk for credit fraud, reports Law360.

Green argued Experian was legally obligated under the Fair Credit Reporting Act to put out credit reports which are as accurate as attainable and that don’t include any adverse information that is obsolete.

Experian agrees to reconfigure update process for non-residential addresses

Preliminary approval of an injunctive relief settlement was granted by a federal judge shortly after discovery in November, with a nationwide settlement Class of consumers certified at that time, reports Law360.

Experian agreed in the injunctive relief settlement to reconfigure its update process for non-residential addresses and to “stop publishing certain Fraud Shield indicators altogether,” among other things.

Final approval of the injunctive relief settlement was granted in April, meanwhile, while the remaining issues continued to be negotiated up to the two deals reached on Friday, reports Law360.

A jury trial began in June for a complaint alleging Experian falsely reported that a Florida consumer was delinquent on his mortgage payment and then passed off the investigation to a seperate company.

If your credit report has been damaged due to identity theft or fraud, you may qualify to join an identity theft credit damage recovery lawsuit investigation.

The plaintiff is represented by Kristi C. Kelly, Andrew J. Guzzo, Casey S. Nash, and J. Patrick McNichol of Kelly Guzzo PLC, Leonard A. Bennett and Craig C. Marchiando of Consumer Litigation Associates PC, and E. Michelle Drake and Joseph C. Hashmall of Berger Montague.

The Experian credit reporting class action lawsuit is Hill-Green v. Experian Information Solutions Inc., Case No. 3:19-cv-00708, in the U.S. District Court for the Eastern District of Virginia.

Due to a certain data breach and wrong inaccurate credit reports my last attempt at a simple $5000 consumer transaction was denied and replaced with $800 loan paid at $325 a week for 21 months and or 490.99999%. Interest. I’ve lived in my current location over 6 years, but show 2 evictions in neighboring counties during this time. Thank you credit bureaus!!!!! You’ve only affected my employment, housing, vehicles, transportation period, bank accounts, utilities, phone service, you pretty much screwed me every way possible!!!! Thank you

  3. David Quast says:

I divorced in October 2019 with a property settlement that gave the home and mortgage to other party. They had 3 months to obtain and execute the mortgage to their name and mine off. This was completed but Experian continued to report the large amount on my report. This affected my ability to buy another house because of insufficient balance equity. I complained to Experian through their app to please re evaluate my info. They did but has since continued to publish a lower significantly my credit score than the other two. I called to inquire in August of 2020 to inquire if I was put into some sort of algorithm. My scores continue today to be significantly different. I finally got to a score of 805 with Experian (while lows of 792, 795) when the other two are 825 and 830. My mortgage loan officer said they do away with the lowest score. I continue to believe I am in an algorithm with Experian that continually affects a lower score.

  4. Mike Jackson says:

Experian refuses to remove identity theft disputed items even after receiving all required documents.

  5. Jennifer Gomes says:

I have names and and phone numbers on my credit reports that I don’t know that are supposed to be my family? Tried and tried to get them removed but I’ve been unsuccessful.

  6. Georgina Kuehne says:

    Please add me as well

  7. Debbie Bobbitt says:

I’m so tired of my credit being affected by them & it’s NOT FAIR TO US ADD ME PLEASE. They HAVE to be held accountable.

  8. Heather Harris says:

I disputed wrong address on my experian report as well as wrong employment information and I am a member of their credit wise thing for credit monitoring and it did effect me getting loans please help.

  9. B Coker says:

Experian has included into my score late payments from 12 years ago and refuses to remove the record despite the accounts being paid in full since. They deny that the information is a factor; however, the factors in credit score summary provided to account members clearly state 12 late payment contribute to your credit score. This continues to impact my on time payment score from being 100% to 54% and speaking to the representatives is the equivalent of speaking to brick walls. Representatives offer a Boost, as though you should pay for them to increase your score. Why can’t accurate reporting of account data be what’s used to show credit worthiness. What can we do to obtain correction?

  10. Regina Allen says:

I have spent money sending certified letters to Trans Union, Experian, and Equifax and it has been a challenge to get old addresses even remove from my report. I have so many data breaches from so many companies, I cannot keep up. Equifax from Montreal Canada sent me a postcard stating I sent a request for my credit report and they could not find a file for me, I have never lived outside of California, so I did not respond, and kept the postcard notified Equifax in Atlanta, GA no response on this issue and again on March 28, 2023.
