Experian false credit reporting lawsuit overview:

  • Who: A Florida jury began hearing opening arguments for a complaint filed against credit reporting agency Experian by Henry John Losch. 
  • Why: Losch claims Experian violated the Fair Credit Reporting Act by falsely reporting he was delinquent on his mortgage payment and passing off the investigation. 
  • Where: The complaint was filed in Florida federal court. 

A jury in Florida began hearing a complaint this week by a consumer accusing credit reporting agency Experian of reporting false information that he was delinquent on his mortgage. 

Plaintiff Henry John Losch claims Experian violated the Fair Credit Reporting Act (FCRA) by not investigating his credit report dispute and passing off the inquiry to Nationstar Mortgage LLC, which he says maintained the debt, Law360 reported. 

Losch argued to the jury that the entirety of Experian’s business relies on it following regulations set by the FCRA, and said the credit reporting agency would likely try to portray the law as complicated. 

Counsel for Experian, meanwhile, claimed Losch’s argument was invalid, arguing it is only required to have “reasonable procedures” in place to guarantee the utmost precision, according to Law360. 

Experian deflected blame for false credit report onto Nationstar 

Experian ultimately deflected the blame toward Nationstar, claiming the company stood by its mistake when questioned by the agency and, additionally, was the actual source of the invalid information.  

Further, counsel for Experian argued Nationstar had already reached an out-of-court settlement agreement to compensate Losch and resolve the claims, Law360 reported. 

Experian also argued Losch had not been financially injured due to the false report since he had not been denied a loan or credit card on account of the error. 

“No one even saw that information,” Experian said, according to Law360. “The information in the reports only went to Mr. Losch.”

Experian has been the target of previous legal claims.
