Meta tracking technology class action settlement overview:

  • Why: The settlement was made to resolve claims Meta violated the privacy of Facebook users with its location tracking technology.

Meta Platforms Inc. has agreed to pay $37.5 million to resolve claims it violated the privacy of Facebook users with its location tracking technology. 

Facebook users asked a federal judge in California on Monday to sign off on the class action settlement, which calls for funds to be distributed to Class Members on a pro rata basis. 

Meta was accused of violating its privacy policy by allegedly collecting, storing, and monetizing the location data of users who had their location services turned off on their mobile devices. 

Facebook users argued Meta used thelocation data it collected in order to benefit its targeted advertising campaigns. 

The Meta settlement will benefit individuals who used Facebook in the US between Jan. 30, 2015 and April 18, 2018 and whose location data was collected by Facebook despite their location services for the Facebook app being turned off. 

Facebook users speculate settlement could have as many as 70 million claimants

The lead plaintiffs in the class action lawsuit speculated that the amount of eligible claimants could reach as many as 70 million consumers. 

“Assuming a class size of approximately 70 million users, the settlement amount represents 53% of what plaintiffs could have recovered under a nominal damages theory based on a judgment of $1 per class member,” Facebook users said, in their motion for preliminary approval. 

Meta previously attempted to get the class action lawsuit dismissed, at which time Facebook users amended the complaint to include a breach of contract claim, reports Law360. 

In 2020, a federal judge in California dismissed a pair of complaints arguing Facebook violated the law by allegedly tracking its users cellular location data without their consent.
