A settlement website is live for a Mercedes class action deal that will cover around 2.5 million vehicles allegedly equipped with moldy heating, ventilating and air conditioning (HVAC) systems.

While the website is live, it is not accepting claims yet. Top Class Actions will provide claim filing instructions as soon as they become available.

Plaintiffs asked the court to preliminarily approve the Mercedes class action settlement in December 2019.

Under the terms of the proposed settlement, Class Members will include current and former owners or lessees of the following Mercedes vehicles: Mercedes-Benz 2008-19 C-Class, 2010-15 GLK-Class, 2012-17 CLS-Class, 2010-19 E-Class, 2015-19 GLA-Class, 2013-16 GL-Class, 2016-19 GLE-Class, 2017-19 GLS-Class, 2012-15 M-Class and 2016-19 GLC-Class.

If granted final approval, the Mercedes class action settlement will provide compensation for owners and leasees of these vehicles for previous HVAC repairs. The company will reportedly pay an unlimited amount to compensate Mercedes drivers for past repairs by an authorized service provider.

Although the payments have no limit, the settlement limits repairs done by an independent service provider to a maximum of $300 per repair. Only $900 in independent service provider repairs will be covered per vehicle.

In addition to past repairs compensation, the Mercedes class action settlement will provide 100 percent coverage for future repairs, if the repairs fall within the vehicle’s warranty coverage period which is four years of the in-service date, or 50,000 miles – whichever is earliest.

Seventy percent coverage will be provided for repairs within the earlier of eight years from the in-service date or 100,000 miles. Fifty percent coverage will be provided for repairs within the earlier of 10 years from the in-service date or 125,000 miles.

In order to receive compensation for past or future repairs, settlement Class Members will need to submit a valid claim form online or through mail. Claim forms will need to be supported with documentation of repairs.

“Class Members can receive Qualified Future Repairs by bringing their Vehicle to an Authorized Service Center, which will determine eligibility and perform the repairs,” the Mercedes class action settlement agreement notes.

“Dispute resolution is available for Class Members who dispute their reimbursements or believe they are wrongfully denied coverage.”

The settlement is currently pending preliminary approval. If the terms are granted initial approval, the settlement will likely proceed to the claims process. If the settlement is rejected, the terms may need to be changed in order to move forward.

    I had a beautiful midnight purple Mercedes i absolutely adore. There were only 600 made in the entire world. Sadly I had to sell it to someone because of this very problem. I was heartbroken and don’t think I’ll ever own another, Lincoln has a great selection of really great luxury cars, i was impressed.

    2018 GLC 250 Coupe here in Australia. Getting this smelly musty smell whenever you first turn on the air con. Dealers trying to dodge the issue. Hope they get sued out of business. Never ever buying another POS like this.

    I own a 2011 E350 Mercedes Sedan. After the first year of having the car, I started experiencing the mold, mildew smell. Im still experiencing the smell continuously every year. Even after having it serviced. The smell causes my allergies to flair up. I have bought several Mercedes during my lifetime and have never experienced this situation before. I dont know how Mercedes can call this a luxury car. They are not accepting the responsibility in addressing their customers concerns either. This puts a sour taste in my mouth in purchasing another Mercedes. Please update me on the lawsuit. Thanks

    Pls keep me informed to class action lawsuit. Purchased 2013 M-Class and I get a foul odor from vents every time the A/C or heat is turned on, more so during or after rain. Mercedes dealership wants $300 to service.

      I have had a Mercedes since 2006 ALL C CLASS that I have had have this smell. Add me please. I have only had 1 that was bought used all others brand new. It started only after washing the car. They have to know the problem but don’t want to fix it.

    Add me please, I own a 2011 E350 Sedan type. The money that someone pays for these vehicles more attention should be paid to their owners. I have gone round for round with Mercedes Benz once before about air conditioner concerns in my C280 and never did they accept any blame. As soon as the warranty had expired of course repairs need to be made before that they would just patch things up.

    I have a 2010 C300 that has a very foul odor when I turn the AC on. Have had the air cabin filter replaced but still have the odor when I turn on the AC. Very embarrassing when I have passengers. Need it resolved. Now I see that it a manufacturer defect. Not good. Not happy.

    Having the same issues (moldy smell coming from MB e350 vents) after running a/c. Have flushed the heater/evap core three times but still the smell returns.

    Purchased a 2013 Gl 450 at first i took it to a shop where they replaced the cabin filters and did a hvac flush and after a couple months the smell came back so i took it 2 more times within that year. so far i spended over 1,200 and i am still stucked today with this same issue! Mercedes should be ashamed of themselves!
