A settlement website is live for a Mercedes class action deal that will cover around 2.5 million vehicles allegedly equipped with moldy heating, ventilating and air conditioning (HVAC) systems.

While the website is live, it is not accepting claims yet. Top Class Actions will provide claim filing instructions as soon as they become available.

Meanwhile, viewers will receive an email notice when this article is updated with more information by using a free Top Class Actions account and clicking the “Follow Article” button at the top of the post.

Plaintiffs asked the court to preliminarily approve the Mercedes class action settlement in December 2019.

Under the terms of the proposed settlement, Class Members will include current and former owners or lessees of the following Mercedes vehicles: Mercedes-Benz 2008-19 C-Class, 2010-15 GLK-Class, 2012-17 CLS-Class, 2010-19 E-Class, 2015-19 GLA-Class, 2013-16 GL-Class, 2016-19 GLE-Class, 2017-19 GLS-Class, 2012-15 M-Class and 2016-19 GLC-Class.

If granted final approval, the Mercedes class action settlement will provide compensation for owners and leasees of these vehicles for previous HVAC repairs. The company will reportedly pay an unlimited amount to compensate Mercedes drivers for past repairs by an authorized service provider.

Although the payments have no limit, the settlement limits repairs done by an independent service provider to a maximum of $300 per repair. Only $900 in independent service provider repairs will be covered per vehicle.

In addition to past repairs compensation, the Mercedes class action settlement will provide 100 percent coverage for future repairs, if the repairs fall within the vehicle’s warranty coverage period which is four years of the in-service date, or 50,000 miles – whichever is earliest.

Seventy percent coverage will be provided for repairs within the earlier of eight years from the in-service date or 100,000 miles. Fifty percent coverage will be provided for repairs within the earlier of 10 years from the in-service date or 125,000 miles.

In order to receive compensation for past or future repairs, settlement Class Members will need to submit a valid claim form online or through mail. Claim forms will need to be supported with documentation of repairs.

“Class Members can receive Qualified Future Repairs by bringing their Vehicle to an Authorized Service Center, which will determine eligibility and perform the repairs,” the Mercedes class action settlement agreement notes.

“Dispute resolution is available for Class Members who dispute their reimbursements or believe they are wrongfully denied coverage.”

The settlement is currently pending preliminary approval. If the terms are granted initial approval, the settlement will likely proceed to the claims process. If the settlement is rejected, the terms may need to be changed in order to move forward.

    Add me. I cant stand the smell when I cut on my air. Went to a Mercedees benz dealership and they wanted me to pay over $700. No way

    2011 C300 with odd and repulsive smell. Keep a can of Lysol in the car and spray through the vent system daily as a countermeasure just so I can run the AC. Without it, it gets pretty rank.

    Always a bad smell coming out of the vents. Doesn’t matter if it’s set to heat or cool air.

    So good to know! My 2018 GLC300 is in the shop right now and my service writer said they would take care of the odor. It’s UNBEARABLE and EMBARRASSING. I’m a Real Estate Agent who drives clients around, making excuses as to why we have to drive with the windows open. BTW, I live in Las Vegas, it’s near 80 degrees here already so I’ve had to try to turn the A/C on, hoping and praying it wouldn’t reek. No luck. It’s truly a sickening odor, when it began happening last year, the previous service guy told me they wouldn’t flush the system until I had 20k miles, to spray lysol in my vents. What? This is a MERCEDES.

    Wow who would ever think a man like myself that really never had anyting myself could feel like I have risen to a higher level when I bought my Mercedes Benz. But shortly after owning it I noticed that when I turned on the ac or just the vent that it will have a foul smell so I took it had it looked at and was told to change the air filters did that and it failed.The smell continued but now it seems as if it was getting worse and Ithought that I was the only one going through the situation until I came across this article of this class action lawsuit. I don’t know how to get in contact with the people whom filed or become an active participant but I really would like to have this problem resolved since I don’t know any other way of resolving it myself. I’m so disappointed because I never would have thought a luxury car of this caliber could be put together so poorly when it comes to the most important thing in which we all need to survive (THE AIR) If anyone have any information about this class action lawsuit please send to email that is associated with this complaint.     We got a MB 2015 GL 450 in November of 2014. Soon we became aware of the smell issue. I spoke to the service advisor and MB corporate office regarding this in 2015. We were told that some luxury models including Lexus has similar issues. When we turn on the AC during the blazing Texas heat the smell becomes more unbearable than the heat. We prefer rolling down the windows over turning on the AC.

    hi my name is Cornell Denson and I have a E320 Mercedes Benz 2001 and I ended up in the hospital never smoke and is still still going to the doctor’s now about respiratory issues and I thought it was asthma but they never could the determine what it was and I’m still on a high doses of medicine now and I never smoked and we couldn’t ever declare find out why was I having respiratory issues and I’m still going through the doctor this happened since 2012 and I’m still we still trying to figure out what caused thiswe still can’t figure out why was I going through these changes but I did have an experienced a real foul smell in my Mercedes back during that time and I still have the best Mercedes now and it’s still having that issue with that Mercedes-Benz E320 2001

      You may want to get checked for mold in your body which can cause health issues
