A settlement website is live for a Mercedes class action deal that will cover around 2.5 million vehicles allegedly equipped with moldy heating, ventilating and air conditioning (HVAC) systems.

While the website is live, it is not accepting claims yet. Top Class Actions will provide claim filing instructions as soon as they become available.

Plaintiffs asked the court to preliminarily approve the Mercedes class action settlement in December 2019.

Under the terms of the proposed settlement, Class Members will include current and former owners or lessees of the following Mercedes vehicles: Mercedes-Benz 2008-19 C-Class, 2010-15 GLK-Class, 2012-17 CLS-Class, 2010-19 E-Class, 2015-19 GLA-Class, 2013-16 GL-Class, 2016-19 GLE-Class, 2017-19 GLS-Class, 2012-15 M-Class and 2016-19 GLC-Class.

If granted final approval, the Mercedes class action settlement will provide compensation for owners and leasees of these vehicles for previous HVAC repairs. The company will reportedly pay an unlimited amount to compensate Mercedes drivers for past repairs by an authorized service provider.

Although the payments have no limit, the settlement limits repairs done by an independent service provider to a maximum of $300 per repair. Only $900 in independent service provider repairs will be covered per vehicle.

In addition to past repairs compensation, the Mercedes class action settlement will provide 100 percent coverage for future repairs, if the repairs fall within the vehicle’s warranty coverage period which is four years of the in-service date, or 50,000 miles – whichever is earliest.

Seventy percent coverage will be provided for repairs within the earlier of eight years from the in-service date or 100,000 miles. Fifty percent coverage will be provided for repairs within the earlier of 10 years from the in-service date or 125,000 miles.

In order to receive compensation for past or future repairs, settlement Class Members will need to submit a valid claim form online or through mail. Claim forms will need to be supported with documentation of repairs.

“Class Members can receive Qualified Future Repairs by bringing their Vehicle to an Authorized Service Center, which will determine eligibility and perform the repairs,” the Mercedes class action settlement agreement notes.

“Dispute resolution is available for Class Members who dispute their reimbursements or believe they are wrongfully denied coverage.”

The settlement is currently pending preliminary approval. If the terms are granted initial approval, the settlement will likely proceed to the claims process. If the settlement is rejected, the terms may need to be changed in order to move forward.

    I hesitate to turn on my air conditioner and when I do I turn it off a few blocks from my home to try and dry everything out. I try. 2013 c300. I am very sensitive to mold and chemicals and smelled this moldy stink the first summer after I purchased my car November 2015. My son will get out if he smells it or he gets a histamine response. No summer trips for us. I’ve gotten yearly sinus infections for the first time in my life after purchasing this car. Every year I need to have it cleaned and serviced or I will not turn HVAC / AC on. I always hope they really clean and not just filter change. I’m left with a chemical smell. I love my car but this is absurd and harmful to my health. I have 38,000 miles on it. Mercedes I would rather have moisture dripping than getting sick. Drill a hole in pan if need be.

    I have a 2015 c class and my air conditioner spells so bad i can’t even keep it on!! I live in Fl! I would like to find out if i can get in on a class action law suit if there is one.

    I bought a used Mercedes E400 Convertible 3 months ago. It has a foul Odor coming from the Ventilation System. It is so bad people have commented on the odor coming from my clothes. It doesn’t seem to matter if its Heat or AC. I took it to the Dealer, they said we never have a problem of this sort. I asked them to pull up the Service Bulletin, they said they had never needed it before. I showed them Documentation of the Class Action suit, they will not honor the settlement. So I guess we just play the game.

    I own a 2017 GLS 450. I noticed a very bad moldy Odor every time The AC was turned on. We complain about it when the vehicle was service but the odor was kept coming back.

    I have had my C-class Mercedes for four and half years. I was diagnosed with mold toxicity last summer. I have no known cause of the illness.
    When I bought my car there was a very strong fragrance that I am now wondering if it was put in the car to cover a mold smell.

      I was also diagnosed with mold in my body and have been VERY ill.

    My 2017 glc 300 has this bad smell when ACis turned on especially more when its hot and you need to crank uo the AC. Dealer kept replacing cabin air filter and flushing vent system, but it keeps coming back.

    I noticed under my passenger side floor mat was covered in mold. I have mast cell disease with anaphylaxis and mold triggers mast cells. I would have anaphylaxis while driving my Mercedes!This is a health issue for everyone! You can not have mold spores blowing around your car. Not to be taken lightly.

    A persistent bad odor is coming out of my HVAC vents in my 2014 E350. Should I go get it repaired and hope this class action goes through for full compensation?

    My HVAC service leaked to the point my insulation in the back seat stunk with a mold and mildew smell.
