Walmart sales tax may be too high in cases in which a customer pays with a coupon, according to some shoppers.

Consumers say that in some cases, they have been improperly charged sales tax at Walmart when they use a coupon. Allegedly, in some cases, the retailer unlawfully charges sales tax based on the full price of the purchase, instead of based on the purchase price after ac upon has been applied, leading to the inaccurate charging of Walmart sales tax. 

According to Connecticut sales tax law and laws in other states, retailers like Walmart are supposed to calculate sales tax based on the “purchase price” of a sale after discounts, including coupons, are applied to a purchase.

Walmart has already agreed to pay a $45 million class action settlement to Pennsylvania customers who claimed that Walmart was improperly charging sales tax in their state. The Pennsylvania Walmart coupon lawsuit was filed by a customer who claimed that he was charged sales tax for two cans of shaving gel when he used a “buy one get one free” coupon to purchase both cans for the price of one.

Walmart may be engaging in the same practices in other states with similar sales tax laws. Now, lawyers are launching an investigation to see if Walmart has improperly charged sales tax to Connecticut residents who used coupons.

In fact, Walmart is not the only retailer that has come under fire for potentially violating state tax laws. BJ’s Wholesale Club and Costco have also faced class action lawsuits from customers who claimed that they calculated sales tax before applying discounts and coupons.

Coupons & Sales Tax Laws: Connecticut Sales Tax

Sales tax laws can vary from state to state. A few states’ tax laws require retailers to calculate sales tax after discounts are applied, and not before. For example, of you purchased a $10 item but used a 50 percent off coupon, you should only be charged for sales tax on $5 of that purchase.

Some customers may not know that they paid too much in sales tax. If you made a purchase from Walmart and you live in Connecticut, check your receipt to see how much sales tax was charged. If you used a coupon, and you were charged sales tax as if you paid full price and did not use a coupon, you and other shoppers may have a legal claim.

Consumer advocates are concerned that Walmart sales tax practices may be in violation of Connecticut sales tax laws. By participating in a Walmart sales tax class action lawsuit investigation, you could receive compensation for your financial injury caused paying too much Connecticut sales tax at Walmart.

Customers should be aware that the Walmart sales tax problem will most likely not occur in cases in which a customer purchases grocery items because usually, grocery items are not taxable. This is the case in most states. However, other commonly purchased items like personal care items and household items, in addition to a range of other times, could have been part of the Walmart sales tax overcharge issue.

    CVS also has this practice. They even put the disclaimer on their coupons stating that taxes will be paid on pre-discount price.
    I have always questioned why that is legal. I think I will contact the state attorney general to see if that process is legal in AZ.
