Capital One class action lawsuit overview:

Capital One unlawfully canceled credit card rewards that were promised to and earned by its customers, a new class action lawsuit alleges.
Plaintiffs NTech Consulting and Nikhil Navkal claim they and other Capital One cardholders were denied their earned credit card rewards when it canceled their credit cards, pursuant to an undisclosed rewards cancellation policy.
“Pursuant to its rewards cancellation policy, Capital One frequently cancels credit card accounts and rewards earned on those accounts when the cardholder is not at fault, such as when the credit card has been subject to fraud or unauthorized use,” the Capital One class action says.
NTech Consulting and Navkal want to represent anyone for whom Capital One closed a credit card account when the cardholder was not in default, and who thereafter did not receive from Capital One payment or redemptions of all the credit card rewards earned by the cardholder (in the form of cash or miles) based on the cardholder’s purchases using the closed Capital One credit card account.
The plaintiffs also want to represent a New York subclass, a subclass of consumers who were issued a Capital One Spark Cash Plus card, and a subclass of consumers whose credit card accounts were cancelled by Capital One for the stated reason that: “Capital One has observed activity on one of more of your Capital One accounts that is inconsistent with typical customer account usage.”
Capital One credit cards rewards contractually promised, class action says
NTech Consulting and Navkal argue that Capital One credit card rewards are contractually promised to cardholders in Capital One’s form agreements and advertisements.
“Even if plaintiffs were in default, which they were not, Capital One was not contractually allowed to unilaterally forfeit their earned rewards,” the Capital One class action says.
NTech Consulting and Navkal claim Capital One is guilty of breach of contract and unjust enrichment and in violation of New York General Business Law and the Equal Credit Opportunity Act, including Regulation B.
The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of statutory, exemplary and punitive damages for themselves and all class members.
Last year, a consumer filed a separate lawsuit against Capital One over claims it left thousands of customers unable to access their bank accounts, process payments or receive direct deposits for multiple days in January 2025.
