Freedom Energy, Montclair, New Dominion and H&P agreed to a $2.6 million class action settlement to resolve claims that wastewater disposal wells contributed to earthquakes in Oklahoma that caused property damage.
The Oklahoma earthquake settlement benefits individuals, municipalities, county governments or tribal governments who owned real property in Oklahoma between Jan. 19, 2019, and the effective date of the settlement and who suffered damages from earthquakes, foreshocks and aftershocks within the state of Oklahoma.
The class action lawsuit alleged that a wastewater disposal well operated by the defendants contributed to the Feb. 2, 2024, earthquake near Prague, Oklahoma, and also in other areas of Oklahoma. The earthquake allegedly caused damage to plaintiffs’ properties.
Freedom Energy, Montclair, New Dominion and H&P are oil and gas companies that operate in Oklahoma.
The defendants have not admitted any wrongdoing but agreed to a $2.6 million class action settlement to resolve the claims.
Under the terms of the Oklahoma earthquake settlement, class members can receive a cash payment based on the amount of property damage they suffered as a result of the earthquakes.
Zone A claimants are those with damaged properties within Lincoln, Payne, Logan, Oklahoma, Cleveland, Pottawatomie, Seminole, Okfuskee and Creek counties in Oklahoma. These claimants will receive 90% of the net settlement fund based on their submitted evidence of damages.
Zone B claimants are those with damaged properties outside of Lincoln, Payne, Logan, Oklahoma, Cleveland, Pottawatomie, Seminole, Okfuskee and Creek counties in Oklahoma. These claimants will receive 10% of the net settlement fund based on their submitted evidence of damages.
If the total approved claim amounts do not exceed the net settlement fund, the net settlement fund will be distributed to approved claimants based on the approved claim amounts. If the total approved claim amounts exceed the net settlement fund, claimants will receive a proportional share of the net settlement fund based on the amount they claimed.
The deadline for exclusion and objection is March 30, 2026.
The final approval hearing for the Freedom Energy class action lawsuit settlement is scheduled for April 9, 2026.
To receive settlement benefits, class members must submit a valid claim form by July 28, 2026.

The class action settlement benefits all persons, municipalities, county governments and tribal governments who owned or have an interest in real property within the borders of Oklahoma between Jan. 19, 2019, and the effective date of the settlement and who suffered damages from earthquakes, foreshocks and aftershocks within the state of Oklahoma.
