The Walmart sales tax class action settlement resolves allegations by plaintiffs Shaun Brandewie and John Newbrough who claim the retail giant failed to refund customers the full price of their purchases when the merchandise was bought in one state county but returned in a different one.
Brandewie and Newbrough claim that they returned items in Cuyahoga County, Ohio but did not receive the full refund of the sales tax they paid at the time of purchase. Although they each claim they lost less than a dollar, they allege Walmart’s return policy is deceptive and shortchanged customers.
According to the Walmart class action lawsuit, the retailer violated the terms of its sales agreement by refunding customers who return items less than the amount they paid when they made the purchase.
Walmart has denied all wrongdoing and liability but agreed to pay $5 million to settle the sales tax class action lawsuit to avoid the burden and uncertainty of ongoing litigation.
Class Members of the Walmart sales tax settlement included individuals who purchased a product from a Walmart or Sam’s Club store in the United States (including online purchases) and who returned the product but the amount of sales tax refunded was less than the amount initially paid between May 2, 2010 and July 16, 2015.
Claimants were entitled to receive a Walmart gift card valued at a minimum of $3 or a maximum of $15, depending on the total number of Class Members who filed timely and valid Claim Forms.
The Walmart sales tax class action settlement was preliminarily approved on July 16, 2015.
The deadline to file a claim for the Walmart sales tax class action settlement passed on Dec. 18, 2015.
