Mint & Lily class action lawsuit overview:

  • Who: Plaintiff Nina Harris filed a class action lawsuit against Fanrock LLC, doing business as Mint & Lily.
  • Why: Harris alleges Mint & Lily misled customers by advertising its products with false, misleading and inflated comparison reference prices.
  • Where: The Mint & Lily class action lawsuit was filed in California state court but removed to federal court in California.

A new class action lawsuit accuses Mint & Lily of falsely advertising its products by using inflated comparison reference prices to deceive customers into believing they were getting a bargain.

Plaintiff Nina Harris’ class action lawsuit claims Mint & Lily’s jewelry products were never sold at the higher prices advertised on its website, making the purported discounts misleading and unlawful.

Harris wants to represent a California class of consumers who purchased one or more items from Mint & Lily’s website at a discount from a higher advertised reference price.

She argues Mint & Lily’s use of inflated reference prices, strikethrough pricing and purported limited-time sales led consumers to believe the products had been listed for sale at the higher price in the recent past.

“Additionally, and alternatively, consumers are misled because the advertised reference price is not the market price,” the Mint & Lily class action lawsuit says.

Mint & Lily’s alleged use of false reference prices violates federal law

Harris claims Mint & Lily’s reference prices were not the market prices, as the products were regularly available at discounted prices.

“On information and belief, all or nearly all the reference prices on the website are false and misleading,” the Mint & Lily class action lawsuit says.

Harris argues Mint & Lily’s products had a market value lower than both the promised former and regular price and the discounted “sale” price.

“By using false reference pricing, [Mint & Lily] artificially drives up demand for the products, and by extension drives up the price of the products,” the Mint & Lily class action lawsuit says.

Harris claims Mint & Lily is guilty of fraudulent misrepresentation, unjust enrichment and negligent misrepresentation and violations of California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act.

Meanwhile, a consumer sued Tapestry Inc. and Coach Services Inc. over allegations they falsely advertised discounts by using inflated “comparable value” prices at Kate Spade outlet stores.
