CVS hydrogen peroxide class action lawsuit overview:

CVS Pharmacy misleads consumers into falsely believing that its hydrogen peroxide product will “assist in the healing process and shorten healing time” for minor cuts and abrasions, a new class action lawsuit alleges.
Plaintiff Michael Lester claims CVS is misrepresenting its hydrogen peroxide product by labeling that it should be used “for treatment of minor cuts and abrasions.”
Lester argues that hydrogen peroxide is not advisable to be used to treat minor cuts and abrasions, something he claims is backed by the Mayo Clinic as well as “numerous medical studies.”
“While the bactericidal effects of hydrogen peroxide can help clean a cut or abrasion and initially kill bacteria, its caustic properties negatively effect healthy cells involved in wound healing,” states the CVS class action.
Lester wants to represent a New York Class and multi-state consumer fraud subclass of consumers who have purchased the CVS 3% hydrogen peroxide product.
CVS Pharmacy accused of selling hydrogen peroxide product for more than what it’s worth
Lester argues he would not have purchased the hydrogen peroxide product — or paid less for it — had he known about the alleged misrepresentations.
“Defendant sold more of the Product and at higher prices than it would have in the absence of this misconduct, resulting in additional profits at the expense of consumers,” states the CVS class action.
Lester claims CVS is guilty of fraud, negligent misrepresentation, and unjust enrichment, and in violation of New York General Business Law, the Magnuson Moss Warranty Act, and several state consumer fraud acts.
Plaintiff is demanding a jury trial and requesting declaratory relief along with an award of monetary, statutory, and/or punitive damages for himself and all Class Members.
A similar class action lawsuit was filed against Target earlier this month over claims the company falsely markets that its hydrogen peroxide solution is an effective treatment for healing minor cuts.
Complaints revolving around the allegedly false marketing of hydrogen peroxide solution were also lobbied against Swan and Walgreens last month.
