WhirlpoolOhio consumers who allege Whirlpool front-loading washing machines are prone to mold growth and produce foul odors have won their right to proceed as a class in a class action lawsuit against Whirlpool Corporation.

The Sixth Circuit Court of Appeals last week upheld a 2010 order by U.S. District Court Judge James S. Gwin granting certification to the consumers, saying:

“[W]e have no difficulty affirming the district court’s decision that common questions predominate over individual ones and that the class action mechanism is the superior method to resolve these claims fairly and efficiently. This is especially true since Class Members are not likely to file individual actions because the cost of litigation would dwarf any potential recovery.”

The Plaintiffs allege in the class action lawsuit that Whirlpool’s Duet, Duet HT, DuetSport and DuetSportHT front-load washing machines contain a design defect that results in the growth of mold or mildew in the machines, foul odors and ruined laundry. Plaintiffs further allege that although they and other consumers have spent time and money trying to remedy these problems, none of those supposed remedies — many of which were recommended by Whirlpool — have done so.

In July 2010, Judge Gwin certified a class of current Ohio residents who purchased a Whirlpool Duet front-load washing machine in Ohio for personal, family or household use and not for resale. Consumers outside of Ohio have also brought claims against Whirlpool that are now pending before Judge Gwin, and for which class certification will be sought.

“The Court of Appeals today reaffirmed that when a company knowingly sells a defective product to thousands of consumers, those consumers are entitled to band together as a class to hold the company accountable,” said the court-appointed lead attorney for the Ohio class. “We are gratified that our clients and the thousands of consumers like them will have their day in court.”

Similar class action lawsuits are currently pending against other front-load washing machine manufacturers for the same defect, including Sears and LG.

UPDATE: On Oct. 30, 2014, a jury decided in favor of Whirlpool, finding that the company did not negligently design the front-loading washing machines and did not breach its warranty to consumers. Attorneys for the plaintiffs say they plan to appeal the verdict.

    I have a Whirlpool Duet and have the mold and funky odor. Have tried tablets and they DO NOT WORK!!!Please let me know what I have to do to become part of this lawsuit? Thanks for your time

    I just saw about a lawsuit on the Whirlpool Duet Washer with mold problems. I have one with that problem and wonder what I need to do to be part of the lawsuit.

    I have the same order problem . Their tablets don’t work either. I have mold and slime inside soap dispenser also.

    We purchased our Whirlpool Duet washer and dryer less than two years ago, and it has been trouble from day one. Is this legit, and if so is it possible for a consumer outside of Ohio to join the suit? If so, how?

    Whirlpool company is a scam! The first front load duet washer we bought from them ,it only work good for six month after that every things go down hill. They have to have fix it six time with in six months until the one year warranty went out. And the problem still remain. . ( moldy smell, door broke twice , spinning problem ) . The clothes always soggy wet , I have to turn the knob to spin cycle twice every time and still not dry enough. It took me twice of time to dry them in the dryer. We ask them to replace us the new washer because this washer was a defective one. They said , they can’t send us the new one , they can only fix it. so I ask them what happen if the warrenty expire and the problem still can’t be fix. They said they will give me extra 6 more month extension to the one warrenty . The last time they try to fix it was around the 1/ 24/11 .it work a little better until 2/5/11 . The same problem return , the clothes are soggy wet. So I call them to fix it , they said so sorry the one year warrenty was expired on 1/31/11 and it not their problem any more. So I ask them , what happen to the six month extension warrenty that they promised ? The said , “what extension ” , it not in the computer? I know right away I got screw by them. Because I trust their words and believe in their big company . Who would thought they are bunch of liars , rip off and unethical people.. A couple months later I received a letter from a insurance company that’s offer me a extension 3 year on my washer and dry for $500 .so I go ahead a bought that policy . A few month later i call the insurane company to send some one to fix my washer . The repair guy came but can’t fix so the company have send me the new one. The second one work find until today , all of sudden , the fricken washer stop working when it half way done and start blinking two code on the screen. so I call the repair guy over , he said he can’t fix it . We have to call whirlpool people to repair it. It cost us too much money and headack on these stupid washer already. It seem like all of their front load washer are crappy . My oldregular washer before , it last me about 12 years. Now these front load washer it only last from 6 month to 1 year only . I ask lots my customers , they have the same problem, they said they wont buy front load washer anymore. And i’m 100% agree with them . Front load washer are a piece of junk . It Crappy and Waste money!!! Please Don’t buy it ! you will regret big time. Save your money!!!! Whirlpool just want to take your money and run . They are bunch of liars don’t keep their promised. I’m sick of these company . And I will make sure other people don’t make same mistake like I do. It very stressful , whose have extra $1000 laid around to buy another washer . I know I don’t . These washer only look pretty but the quality are suck!!!!!! Stay away from these washer !

    I too have had the mold issue, musty odor, spinning problems, drainage issues and timer has always been whacky and they didn’t want to do anything about ANY of it!

    I also have the same issue….I wipe the water out and left the door open but with little grandkids and my cats I am not happy about the safety of leaving the door open! UGH…. We spent to much $$ to just go out and buy a different washer. What do we do???

    I have the same issue and am constantly running an empty load with bleach and handwashing the rubber. Also have had issues with the door cracking. I’m “in” for the lawsuit…what do I have to do?

    Our machine also has a foul odor, we have to keep the door opened about 2 inches when we are not using it, if we don’t the odor is awful when we open it. Mine also has a problem with spinning and with the cycle timer, the timer will show 1 minute and not shut off for at least 5 to 10 minutes.
