Santander Consumer USA Charged with TCPA Violation

Santander Consumer USAThere has been a class action lawsuit filed against Santander Consumer USA for allegedly violating the Telephone Consumer Protection Act (TCPA) as well as the Fair Debt Collection Practices Act. The plaintiffs have also charged the company with breach of contract for allegedly charging improper fees.

Santander Consumer USA, according to their website, is “a leading company in the automotive finance sector.” However, the company has been accused of using “heavy-handed tactics” to get consumers to pay up on these loans, including allegedly violating the TCPA.

There are several federal laws that a debt collector must adhere to regarding their practices. One of these laws is the Telephone Consumer Protection Act, which prohibits companies from calling consumers on their cell phones using an automatic dialing machine (robo-dialer) or a pre-recorded message without their permission.

Plaintiffs in the Santander Consumer class action lawsuit accuse the company of making repeated and even harassing calls to their cell phones in violation of the TCPA.

If you have dealings with Santander Consumer and believe they are violating the Telephone Consumer Protection Act, you should contact a TCPA lawsuit attorney right away. It is also suggested that you do not sign any agreements with the company until you have consulted a qualified attorney in order to protect your interests.

    I’ve been a victim of Santander, I had to do a voluntary repo due to them not accepting my payments after being late once. It took them months to come get the vehicle. In those months of them not coming to get it they piled a bunch of fees to my account and reported it as late. They told me that due to me not being in the car they could not come get it. I also didn’t understand why my balance wasn’t going down every time I would make a payment. I should have paid off my vehicle in 3 years which I made enough payments for it to be paid off but I couldn’t. I need in on this lawsuit ASAP!

    I ended up having my car voluntarily repossessed with Santander. I had gotten one month behind and although I was making payments, I could never get that one month paid. When they started calling my cell phone 20 + times a day on a Sunday, and my work place (a school) even after telling them NOT to call me at work, I knew I had to do something. Now my credit is wrecked because I have a repossession on there. They told me that they would no longer be able to work with me if I didnt catch that one month up, even though they were more than happy to take the payments I was making.

    Needed a vehicle in January 2010 and had to get a used 2007 Ford Escape which the used car lot financed me through Santander. Vehicle was financed at 18000 at 19%. The loan is supposed to be done in April 2016 but after all these years of paying on it, I still owe 6500. The Ford was in both my name and my wifes name but she did not re affirm it after her BK7 in 2012 so now this account resides in their BK department. Since 2012, I no longer have access to Santander website, get monthly statements or phone calls and nothing has been reported on my credit reports since 2012. I just make my $383 payment every month through my bank bill pay. I need help!!!!!!! Please!!!!!. I feel this is not right.

    I too have been a victim of Santander. My loan was suppose to be paid off in September 2014, After my loan was done they demanded another 8000 for my Truck which was 30,000 loan to begin with and if I didn’t agree to paying that I would have lost it, so of course I have agreed to pay them another 8000 so that I can keep my truck. also when signing the new contract ( I was reading the little Claus about not being able to sue them in a class action suit)..the reasoning was late fees and interest they said that is why I owe them 8000.. which I knew better, If my husband would not have so many medical problems going on at the same time I would have sued them myself.,This company is ripping people off how can they get away with this. this is one of the worst companies I will never buy another car and have it financed again!

    Experienced these issues, need a lawyer in southern calif. I obtained car loan $20,000. Made 57 monthly pmt amts $515.53 sometimes I would pay more to requesting to apply remaining credit to principle balance ! Called several times through the years , representives lie and never is my pmts posting , Nor When I make the Pmt … 8-9 days later ! Which more fees are applied! Without my knowledge … with that being said I HAVE PD $29380.00! And Still Owe $10+ k!. So frustrating, this is just a few issues.. Santander needs to be stopped! This is affecting my credit.. How can this be, they are liars scum if the earth! Can anyone provide me info for a good lawyer?

    I have also told them that there are some times that there may be a time where I can only pay a little and first they say that will be fine or okay then they tell me no I can’t .so I am tired of being harassed .

    I am very frustrated with Santander cause it seems like every time I make my payment the total balance of the vehicle goes up instead of decreasing and I am very.upsey on how they have been treating me . Everyone that I talk to I will tell them how sorry of a company yall are .

    I to Have Santander my loan was originally from Citi, It has been a night mare dealing with this company. My Auto pay off date was last month which I had a 5 year loan., but for some reason they say I owe another 10,000 when my bill came in the mail and I seen a the amount due I about flipped. how could this be they said with late payments deferments, and the interest.. I seen that only a few dollars was going towards principal on every payment. so by the time said and done I will have paid over 40,000 for my truck. This is ridiculous I have been paying over 600.00 a month for this and now its still not paid off. and not to mention I have a 10 day grace period 1 day after its due the harass us call the phone all day long. where is the grace period? please help as I want in on the law suit.
