Samsung Z Fold 3 class action overview:

  • Who: Antonio Lewis filed a class action complaint against Samsung Electronics America, Inc.
  • What: The plaintiff alleges the Samsung Z Fold 3 phone has defects related to its fold functionality.
  • Where: The lawsuit was filed in New York federal court.

Antonio Lewis filed a class action complaint against phone maker Samsung, which alleges that the Z Fold 3 phone’s folding technology does not live up to promises of durability.

According to the lawsuit, Samsung promotes in its advertising that the phone holds up to rigorous tests, saying it can be folded and unfolded more than 200,000 times, the equivalent of five years of usage.

The Samsung Z Fold 3 class action, however, alleges that the phones have a high percentage of screen failures, which begin with a minor crack or a crack running the length of the fold.

The lawsuit claims the Samsung Z Fold 3 is “highly susceptible to screen damage, including corrupted pixels, through microscopic particles getting under the protective film at the hinge, creating air pockets.” The lawsuit also alleges that cold temperatures can cause the screen protector to snap instead of bend.

Faulty testing didn’t include real-world use, Samsung class action claims

The lawsuit claims that Samsung’s testing environments did not include real-world applications that expose the phones to environmental factors such as temperature swings, dust, sweat, water and normal day-to-day handling of the device, all of which can affect the durability and functionality of the hinge.

The plaintiff bought the phone for around $1,800 in 2021, he claims. When his phone was no longer functional after less than one year of use, Lewis attempted to get coverage from Samsung, but he alleges he was told screen repair was not included. He was told the repair would cost him more than $500, according to the Samsung Z Fold 3 class action.

The class action complaint alleges that Samsung used “unfair, misleading and deceptive representations, omissions and actions” in selling the Samsung Z fold 3 phone. It claims Samsung violated New York Business Law, the Virginia Consumer Protection Act and state consumer fraud acts (which cover North Dakota, Wyoming, Idaho, Alaska, Iowa, Mississippi, Arkansas, North Carolina and Utah). The Samsung lawsuit cites breaches of contract, express warranty, implied warranty of merchantability/fitness for a particular purpose and the federal Magnuson Moss Warranty Act.

Samsung has faced legal action over folding devices before. A class action lawsuit in 2021 claimed laptop hinges, marketed as a 2-in-1 tablet device, were also defective.

Paid $2000 for Samsung Z Fold 3. Sent out for repair of misfunctions related to inner screen. Black blank line down the center. No fault of my own. Quoted $900 in repairs. I want to sue, join any class action and get the word out. Not too many of us bought this phone, yet all of us have similar complaints.

There is another lawsuit waiting to happen. There are so many complaints on the internet about the Zfold 3 not having sound when opened fully. It appears that is was caused by an update, and Samsung does nothing about it. Mine went out with the last update and has sound as long as it is closed or half way open, but not fully opened. This is a widespread problem that should be addressed.

I purchased the flip 4 in August 2022. October 2022 I opened my phone and there was a black strip across the screen where it folds. I closed the phone and opened back up, and 85% of my screen went black. I sent my phone to Samsung and they said I broke my hinges. Huh? I broke the hinges …..yea right! They changes the screen and sent me another phone. Within a year it happened again and Samsung refused to change it. I had to pi4chase another phone. November of 2023 my mother’s flip4 protective screen separated from the actual screen then started to turn black. Luckily she had insurance so she was aboit to get another phone with a $100 deductible. March 2024 my husband flip4 had the same black strip across the fold. He opened and closed it a couple more times and the whole screen went black. He just had to purchase another phone. I was at a family party yesterday and notice my cousin had the flip. I asked him about his screen. He told me he’s already replace his screen once and the protector is separating again. This phone is horrible and all who purchased need to be made whole.

    1. Michael J Carney says:

My inner screen went black. Says need replacement.

  6. Larry Myers says:

I have the same issue as others with a 2023 7 month old Z fold 4 screen where the screen protector separates and have hit a wall with Samsung Care. If a class action is open, I would like to join.

I’m having all kinds of problems with my flip phone.

  8. SHAKATA R JONES says:

I opened my phone and it has a black line down the middle and the right side does not work I was told I can get 20% off if I turn it In or repair.but I would have to pay for repairs as it is out of warranty but it is there flaw

    1. Heather gendler says:

      Ditto I am so frustrated

  9. John Ottenstein says:

My Z Flip 4 was purchased in late 2022. The fold mark has increased in size just the last couple of days. It has started to make a little noise when opening the phone. While the screen still seems OK except in the area of the fold location. This Z Flip 4 has always been carried in a case designed for the phone and has never been dropped. I use my home phone most of the time and rarely use the Z Flip 4. I feel there is a manufacturing defect that should be covered by Samsung.

    1. BAS says:

      Agreed

  10. Kevin Daly says:

Same as every one else with their Samsung z fold 3, I just opened it up and middle pixels are dead along the fold line and right side has no function.
This phone barely gets opened so for it to stop working like this is a huge piss off !!!
$2500 for a phone that doesn’t withstand daily use and isn’t abused is ridiculous.
With the promise of being able to open and close hundreds of times, Samsung definitely didn’t hold their end of the bargain here did they !?
Good thing the front portion still works as I can’t afford to buy another phone right now !!!

These fold phones are great until they break – stay away from them at all costs
