Samsung Z Fold 3 class action overview:

Antonio Lewis filed a class action complaint against phone maker Samsung, which alleges that the Z Fold 3 phone’s folding technology does not live up to promises of durability.

According to the lawsuit, Samsung promotes in its advertising that the phone holds up to rigorous tests, saying it can be folded and unfolded more than 200,000 times, the equivalent of five years of usage. 

The Samsung Z Fold 3 class action, however, alleges that the phones have a high percentage of screen failures, which begin with a minor crack or a crack running the length of the fold. 

The lawsuit claims the Samsung Z Fold 3 is “highly susceptible to screen damage, including corrupted pixels, through microscopic particles getting under the protective film at the hinge, creating air pockets.” The lawsuit also alleges that cold temperatures can cause the screen protector to snap instead of bend.

Faulty testing didn’t include real-world use, Samsung class action claims

The lawsuit claims that Samsung’s testing environments did not include real-world applications that expose the phones to environmental factors such as temperature swings, dust, sweat, water and normal day-to-day handling of the device, all of which can affect the durability and functionality of the hinge.

The plaintiff bought the phone for around $1,800 in 2021, he claims. When his phone was no longer functional after less than one year of use, Lewis attempted to get coverage from Samsung, but he alleges he was told screen repair was not included. He was told the repair would cost him more than $500, according to the Samsung Z Fold 3 class action.

The class action complaint alleges that Samsung used “unfair, misleading and deceptive representations, omissions and actions” in selling the Samsung Z fold 3 phone. It claims Samsung violated New York Business Law, the Virginia Consumer Protection Act and state consumer fraud acts (which cover North Dakota, Wyoming, Idaho, Alaska, Iowa, Mississippi, Arkansas, North Carolina and Utah). The Samsung lawsuit cites breaches of contract, express warranty, implied warranty of merchantability/fitness for a particular purpose and the federal Magnuson Moss Warranty Act.

Samsung has faced legal action over folding devices before. A class action lawsuit in 2021 claimed laptop hinges, marketed as a 2-in-1 tablet device, were also defective.

    I am actually on my third zfold. Had to replace the first one less than 6 months after I received it. I tell everyone who thinks this is a “cool” phone to stay away from them because of the screen cracks. On top on the price we paid for the phone, I have had to pay $100.00 each time they replace it and I have the insurance on it.

    I am on my 2nd fold 3 and they both have done the
    same thing. When I got this one, about 3 months ago because the screen started acting up and the sound wasn’t working. This is crazy. Will there be a lawsuit?

    My fold3 center screen has quite. Front screen working some. Cannot make calls on the phone. No drop damage. Seems everything there’s an update something else changes. So my phone is about 18 months old on a 3 year contract. I can’t see very well so I buy the biggest screen I can but now screwed. It’s worthless an I’m paying every month for a phone I can no longer use.

    Our local Best Buy is a designated Samsung repair shop. My Flip 4 screen cracked 1 yr and 2 weeks after purchase from Spectrum mobile. They have had it for two months, huge backlog of these phones in for repair. I’ve been charged $350 with no return date in sight. How do I join the class action suit. I’m P’d off and want justice!!

    My $1100 z flip lasted 15 and a half days of light use in a store bought and installed protective case the return period was 15 days im devastated not they want me to take it to get repaired so I can deal with it again when it breaks in 15 more days.

    does lemon law apply here?

    I am on my 3rd z flip in 2 years! Same issue with screen protector lifting and cracking in the fold, dead pixels and had to.pay to replace each device. The screen.protector on the last one cracked in the first few days of reviewing it! Done with Samsung after this!

    how do you join claim I have Samsung galaxy4 and it has defect with manufactory screen saver. It has air bubble. they know of ongoing issues. paid $1800

    How do I join the lawsuit? Screen broke in about one year, no warranty and not willing to pay over $500 for a screen that will last 12 months.
