Samsung Electronics America Inc. makes and sells gas stoves, ovens and ranges without informing consumers that gas cooking has “significant pollutant risks,” a new class action lawsuit alleges.
Plaintiff Jeffrey Hess filed the class action lawsuit against Samsung Electronics America Inc. on March 27 in an Illinois federal court, alleging violations of state and federal consumer laws.
According to the lawsuit, gas stoves have risks associated with them, such as emitting nitrogen oxides, which are gasses that can worsen asthma and other lung diseases,” it says.
This risk is avoidable and manufacturers can reasonably design gas stoves to mitigate the risk of pollutants, Hess says.
“Despite this, Defendant failed to use an alternative design to avoid these harms and reduce harmful pollutants from gas stoves,” he says.
Samsung should have warned consumers, lawsuit states
Manufacturers can — and should — disclose the risk of pollutants to consumers, who can then make an informed choice about whether to buy a gas stove or an electric stove, the lawsuit states
However, consumers remain unaware of the risks because nothing on Samsung’s packaging, instructions, or warning labels suggest that the gas stoves regularly emit pollutants that are harmful to human health, Hess alleges.
“Further, the labels and warnings do not mention any risk of nitrogen oxides.”
As a result, he is suing on behalf of a nationwide class of consumers who bought Samsung gas stoves, plus an Illinois subclass.
He is suing for breach of warranty, fraudulent omission and breach of state consumer laws and seeks certification of the class action, damages, fees, costs and a jury trial.
Meanwhile, LG Electronics USA Inc. is facing a class action lawsuit alleging it failed to disclose the risk of pollutants associated with its gas stove models, depriving consumers of the ability to make an informed choice before purchasing the product.
Earlier this year, the head of the U.S. Consumer Product Safety Commission (CPSC) clarified that it does not plan to place a ban on gas stoves days after a member of the agency said it was considering prohibiting the devices.
