Procter & Gamble Shampoo Benzene Dry Shampoo Conditioner Class Action Lawsuit Overview:

  • Who: A group of consumers have filed a class action lawsuit against The Procter & Gamble Company.
  • Why: The consumers claim P&G sold certain aerosol dry shampoo and dry conditioner spray products containing the chemical benzene, a known human carcinogen.
  • Where: The class action lawsuit was filed in Ohio federal court.

Procter & Gamble (P&G) has been hit with another class action lawsuit alleging it sold a range of aerosol products that were contaminated with the chemical benzene, a known human carcinogen.

Plaintiffs Cheri Casolari, Dan Lewis, Berenice Bernier, Chaka Theus and Sondra Trent filed the class action lawsuit against The Procter & Gamble Company May 2 in an Ohio federal court, alleging violations of consumer laws.

The benzene was discovered in specific aerosol antiperspirant and deodorant sprays under P&G’s Old Spice and Secret brands and specific aerosol dry conditioner and dry shampoo products under its Pantene, Aussie, Herbal Essences and Waterless brands.

The plaintiffs say they were deceived by P&G’s “omissions” regarding the presence of benzene in the products.

“Due to this wrongful conduct, consumers—including Plaintiffs and members of the classes—purchased and otherwise overpaid for P&G’s Recalled Products,” the P&G class action lawsuit states.

P&G Benzene Contamination Revealed By Independent Study In May 2021

The benzene contamination came to light following a study by Valisure, an independent analytical pharmacy, which revealed in May of last year that a number of cosmetic and health products contained the cancer-causing chemical.

The plaintiffs are looking to represent a nationwide class of consumers who bought the recalled products, as well as an Illinois, Arizona, California and Florida class.

They are suing under state consumer laws and federal warranty and unjust enrichment laws, and seeking certification of the class action, fees, costs, damages, interest and a jury trial.

Several other class action lawsuits have been filed against P&G over the alleged benzene contamination in its products, including its deodorant and antiperspirant sprays.

The plaintiffs are represented by Joseph F. Murray of Murray Murray Moul + Basil LLP and Robert C. Schubert, Dustin Schubert and Noah M. Schubert of Schubert Jonckheer & Kolbe LLP.

The P&G Benzene Class Action Lawsuit is Cheri Casolari et al., v. The Procter & Gamble Company, Case No. 1:22-cv-00235-SJD, in the U.S. District Court Southern District of Ohio Western Division.
