P&G Shampoo Benzene Class Action Lawsuit Overview: 

  • Who: Nancy Martinez filed a class action lawsuit against The Procter & Gamble Company. 
  • Why: Martinez claims P&G sold certain aerosol dry shampoo and dry conditioner spray products containing the chemical benzene, a known human carcinogen.
  • Where: The class action lawsuit was filed in Florida federal court.

The Procter & Gamble Company distributes, markets and sells aerosol dry shampoo and dry conditioner spray products containing the chemical benzene, a known human carcinogen, a new class action lawsuit alleges. 

Plaintiff Nancy Martinez claims P&G fails to disclose through its advertising or labeling that its products — sold under brand names Waterless, Pantene, Herbal Essences, Aussie, Hair Food, and Old Spice — contain benzene. 

Martinez argues she would not have purchased the aerosol spray products had she known they contained benzene. 

P&G announced a voluntary recall for a number of its aerosol dry shampoo spray products in December; however, the company failed to disclose the levels of benzene that were detected, according to the class action lawsuit.

Martinez argues that not disclosing the levels of benzene found in its products is “concerning” and leaves consumers vulnerable if the company continues to use traces of the chemical in its manufacturing processes. 

Contamination Revealed By Independent Study In May 2021

The benzene contamination came to light following a study by Valisure, an independent analytical pharmacy, which revealed in May of last year that a number of cosmetic and health products contained the cancer-causing chemical.

In November of last year, Valisure petitioned the U.S. Food and Drug Administration to recall the products, including those allegedly purchased by Martinez, discovered to contain traces of benzene. 

Martinez claims P&G is, among other things, guilty of unjust enrichment and in violation of Florida’s Deceptive and Unfair Trade Practices Act

Plaintiff is demanding a jury trial and requesting declaratory relief along with actual and statutory damages for herself and all class members. 

Martinez wants to represent a nationwide class and Florida subclass of consumers who purchased any of the affected P&G products for personal use or consumption. 

A wave of class action lawsuits have been filed against numerous companies following the Valisure study, including Walmart, Thriving Brands LLC and Bayer, among others. 

Several other class action lawsuits have been filed against P&G over the alleged benzene contamination in its products, including its deodorant and antiperspirant sprays

    I have ordered these products all through Amazon. Amazon should be held accountable too and a class action should be filed against them for not having better standards to keep their customers safe.
