Nissan bill fee class action lawsuitA federal court has preliminarily approved a class action lawsuit settlement alleging Nissan North America concealed from consumers that it’s Pathfinder, Xterra and Frontier vehicles had defective radiators. If you bought or leased a 2005-2010 model year Nissan Pathfinder, Nissan Xterra or Nissan Frontier, you may be entitled to repair reimbursements and/or an extended warranty from the class action settlement.

The Nissan radiator settlement will resolve a class action lawsuit, titled In re: Nissan Radiator/Transmission Cooler Litigation, that alleges these vehicles contain a defect that permits cross-contamination of engine coolant and transmission fluid, ultimately causing the radiator and transmission to fail or need substantial repairs. The class action lawsuit further alleges that Nissan failed to disclose the alleged radiator defect to consumers despite knowing about it.

Nissan denies the allegations, but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the Nissan radiator class action settlement include all current and former owners or lessees of a 2005-2010 model year Nissan Pathfinder, Nissan Xterra, or Nissan Frontier vehicle in the United States and its territories, including Puerto Rico. Fleet and governmental purchasers and lessees are not included.

Class Members are entitled to a number of benefits from the Nissan radiator defect class action settlement, including:

Authorized Repair

  • Nissan will cover repair costs over $2,500 to fix the covered radiator defect if at the time of repair your vehicle exceeds eight years or 80,000 miles, whichever is less, but has less than nine years or 90,000 miles. You will be responsible for paying only $2,500.
  • If at the time of repair, your vehicle exceeds nine years or 90,000 miles, whichever is less, but has less than 10 years or 100,000 miles, and the repairs cost more than $3,000, Nissan will cover the repair costs over $,3000. You will be responsible for paying only $3,000.

 

Reimbursement for Previous Repair

  • If you previously paid for repair to or replacement of a damaged vehicle component caused by the radiator defect and can provide proof of such costs, Nissan will reimburse you for related costs you paid over $2,500 if at the time of diagnosis your vehicle exceeded eight years or 80,000 miles, whichever is less, but had less than nine years or 90,000 miles.
  • Nissan will reimburse you for related costs you paid over $3,000 if at the time of diagnosis your vehicle exceeded nine years or 90,000 miles, whichever is less, but had less than 10 years or 100,000 miles.

 

The Nissan radiator class action lawsuit settlement benefits include an extension of Nissan’s warranty coverage in the New Vehicle Limited Warranty on the radiator assembly to 10 years/100,000 miles, whichever occurs first, subject to certain customer co-pays that vary with age/mileage above 8 years/80,000 miles. This extension covers the radiator and component parts, and includes damage, repairs, replacement and related towing resulting from this issue.

If you wish to receive a reimbursement from the Nissan class action settlement, you must submit a Claim Form and any supporting documents no later than June 7, 2013.

    I’m 43 years old & I grew up on a junkyard where examining & tearing apart cars was a dailey thing.. I couldn’t begin to say how many hoods I’ve been under since I was 3 years old & I’ve never seen what I saw today under the hood of our 2003 Nissan Murano! The entire top of the radiator blew up! Of all places to be was at the Elementary School picking up our children.. We’ve reported it to Nissan so we’ll see what they say about this uncalled for incident…

    Same issue here with my 08 Frontier with 103,000 miles on it. Just started having issues recently and turns out it’s the cross contamination nightmare. I’m beyond aggravated that Nissan didnt recall these radiators. There’s no way they can claim they were unaware of the problem. I’ve been a loyal Nissan enthusiast for over 20 yrs but no more after this. I hadn’t heard of this issue before now or I would’ve replaced the radiator long ago to avoid this. And I agree with what someone said earlier about the dealer not informing them either. I bought my truck new from my dealer and had it serviced there for 10 yrs and not once was there mention of this issue. Would’ve been nice. I’m beyond disgusted.

    I bought an 06 pathfinder or cash in 2010, now my husband n I are both disabled, I have 179,000 on it I’ve taken good care of it and just started having problems with my tranny my husband looked in the radiator n sure enough white sludge, he said it has to be an eternal leak somewhere! I googled to see if there were ne problems n sure enough, I never received any recall about this so I called Nissan and of course they are very sorry they can’t help me! I’m pissed I’m calling a lawyer, I will go to the news, this is so unfair to all of us…

    I’ve have never seen such a scam! How can nissan get away with ripping off thousands of people that have to pay thousands of dollars to pay to fix all these vehicles! I just don’t understand how the government lays back and does nothing about this problem. It just goes to show you how messed up our country is. I can’t stand people that take hard earned money out of your pocket because of the greed that exists in this world! How simple it would have been just to change defective radiators in these vehicles. This is going to bite nissan in the ass for a long time! I know I will never forget and will always be writing all over, social media , any where I can to make nissan pay. Good luck nissan your going to need it. Carma is a bitch!

    I have run into same problem on a 2007 Pathfinder with 121,000 miles on it. Radiator has milky film indicating cross contamination and transmission is laboring to shift. Going to try RR radiator and a thorough transmission flush; crossing my fingers it will work or I have to have transmission rebuilt or replaced.
    The whole scenario stinks as I just RR tires and had a major tune up replacing spark plugs, air filter and scheduled oil change.
    My brotherinlaw is a mechanic and said he has seen this problem with these vehicles before.

    How do dealerships get away with this? This just happened to our son yesterday….they auto repair shop informed him of the issue with Nissan Xterras when quoted him the $5000 repair bill. This is our second Xterra we owned and gave it to him with about 90,000 miles on it, telling him he will be worry for for at least another 50,000 to 100,000 miles. Then this happens. We never received any notification from Nissan about issues and never received a class action lawsuit notification.

    I have a 2010 Xterra. Was that effected? The serial number is 21460-ZL11A. Is that serial number a radiator with the defect or is it fixed?

        I just contacted Nissan with this problem and was basically told there is nothing they can do about it. I have to pay the fees all out of my pocket because I was over mileage. I will never buy a Nissan again they knew this was an issue and never said anything to me about it. I go to Nissan all the time and at no point did anyone ever mention this to me. So angry right that they can get away with this.

    I am seeking help from Nissan North America based on the fact that I was never informed of a class action law suit until after the fact that the defective radiator caused my transmission to fail. We have one single vehicle that my husband and I share. Our 2008 pathfinder has run into this problem and now costing me nearly $6000.00 in repairs.
    I am furious that my dealer has never mentioned this problem, we have all of our service directly from the dealer’s service shop because we have always trusted they were looking out for OUR best interest. I am sadly mistaken to have believed the dealer would been willing to help us avoid any major diagnostic problems.

    I am not getting any satisfactory answers. Nissan claims representative states they do not have an owner listed for our “VIN”. That’s highly suspicious because I have received recalls in the past on this vehicle. We are the first and only owners of this Pathfinder.

    Does anyone have any suggestions for me?
    I am pleading for as much help in fighting this as I possibly can.

      Same thing just happened to me on October 12, 2017. I was on the highway when this happened and was lucky not to have caused an accident. No notice from Nissan EVER received. Nissan knew of the dangers and NEVER issued a recall of these vehicles. Now, I’m looking at over $6,000 in repairs for my 2008 nissan xterra with only 99998 miles. I will never purchase another nissan again because the corporation is sleazy and doesn’t care about owner safety. This was my 3rd nissan vehicle and it will be my last.

    I have a Nissan Pathfinder 07. It has exactly same problem. The stupid dealer quote me $4,000 to replace Radiator and Transmission. I just find out this website after having this problem. I agree that Nissan turned back to us, while knowing this faulty design problems for years.

    Same issue 06 xtera cross contamination, never again will I buy a Nissan, and I have made sure all my friends and family are aware that Nissan burnt its consumers.
