Nissan bill fee class action lawsuitA federal court has preliminarily approved a class action lawsuit settlement alleging Nissan North America concealed from consumers that it’s Pathfinder, Xterra and Frontier vehicles had defective radiators. If you bought or leased a 2005-2010 model year Nissan Pathfinder, Nissan Xterra or Nissan Frontier, you may be entitled to repair reimbursements and/or an extended warranty from the class action settlement.

The Nissan radiator settlement will resolve a class action lawsuit, titled In re: Nissan Radiator/Transmission Cooler Litigation, that alleges these vehicles contain a defect that permits cross-contamination of engine coolant and transmission fluid, ultimately causing the radiator and transmission to fail or need substantial repairs. The class action lawsuit further alleges that Nissan failed to disclose the alleged radiator defect to consumers despite knowing about it.

Nissan denies the allegations, but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the Nissan radiator class action settlement include all current and former owners or lessees of a 2005-2010 model year Nissan Pathfinder, Nissan Xterra, or Nissan Frontier vehicle in the United States and its territories, including Puerto Rico. Fleet and governmental purchasers and lessees are not included.

Class Members are entitled to a number of benefits from the Nissan radiator defect class action settlement, including:

Authorized Repair

  • Nissan will cover repair costs over $2,500 to fix the covered radiator defect if at the time of repair your vehicle exceeds eight years or 80,000 miles, whichever is less, but has less than nine years or 90,000 miles. You will be responsible for paying only $2,500.
  • If at the time of repair, your vehicle exceeds nine years or 90,000 miles, whichever is less, but has less than 10 years or 100,000 miles, and the repairs cost more than $3,000, Nissan will cover the repair costs over $,3000. You will be responsible for paying only $3,000.

 

Reimbursement for Previous Repair

  • If you previously paid for repair to or replacement of a damaged vehicle component caused by the radiator defect and can provide proof of such costs, Nissan will reimburse you for related costs you paid over $2,500 if at the time of diagnosis your vehicle exceeded eight years or 80,000 miles, whichever is less, but had less than nine years or 90,000 miles.
  • Nissan will reimburse you for related costs you paid over $3,000 if at the time of diagnosis your vehicle exceeded nine years or 90,000 miles, whichever is less, but had less than 10 years or 100,000 miles.

 

The Nissan radiator class action lawsuit settlement benefits include an extension of Nissan’s warranty coverage in the New Vehicle Limited Warranty on the radiator assembly to 10 years/100,000 miles, whichever occurs first, subject to certain customer co-pays that vary with age/mileage above 8 years/80,000 miles. This extension covers the radiator and component parts, and includes damage, repairs, replacement and related towing resulting from this issue.

If you wish to receive a reimbursement from the Nissan class action settlement, you must submit a Claim Form and any supporting documents no later than June 7, 2013.

    Loved repeat LOVED PATHFINDERS. Until I purchased my second one. 2007 Nissan Pathfinder. Boy, I thought I was on cloud nine when I was driving home my new Pathfinder it was new to me anyway the first Pathfinder I ever bought was a 1994 Nissan Pathfinder 4X4 limited edition. I paid $16,000 off the lot it was used but I loved it drove it all the way up until 2013. Things are going great in my life I have excellent credit I was 48 years old I thought what the heck I’ll go ahead and buy this and then I drove it off the lot I thought something seems strange but I figured it was the sturdiness of the tires there was a some sort of jerking on the highway I thought it’s got to be the tires gripping. So what do I do I Google it. Jackpot I had just purchased the biggest lemon ever course the dealership offered me an extended warranty that would be the only way they would finance my vehicle for what reason I don’t know but I went along with it I credit with 780 hadn’t got a car since I was 21 years old so I was ready for a new car period got the extended warranty if I wouldn’t have done that I would have spent over $10,000 just in the first six months 2 a year. I asked the dealership about it they knew nothing about the radiator transmission contamination I find that hard to believe. It would seem to me if you’re in the business of cars he would know about the defects. In my opinion I don’t think those car should have even been sold it was a reputable dealer at least I thought and now I believe there are no reputable dealers. I guess the reality check at the age of 50 now so basically I’m driving a time bomb period Nissan really needs to recall this Autumn will be home I would never ever ever buy another Pathfinder again I’ll go to Toyota Orr Honda shoot maybe I’ll even go American. It just sickens me that it any moment I could have this massive could catastrophe and then what would I do since buying this car my credit has going to 400 lost my job if something should happen to my vehicle that’s what I’m out they never realize the domino effect you have when you don’t have integrity mr. Nissan period you are losing customers trust me Pathfinder doesn’t look all that great anymore anyway and I’m a woman so it was always for looks with me looks like a station wagon now you really need to be fed up and we call because we like Integra like people we can believe in this fake news era I want to believe in something. It really is a shame shame on you Nissan Shame Shame Shame and shame on you for selling me that 2007 Nissan Pathfinder Timebomb sure was pretty on the outside the inside not so much oh and PS could you also make sure your timing belt timing chain last a little longer than it did thank goodness I had the extended warranty I had to put in a new timing chain also check the tire pressure sensor and the seat belt passenger side it’s just a shame little plastic hair marketing and packaging and good name and I bought it Hook Line & Sinker never again recall the 2007 Nissan Pathfinder how many more complaints is it going to take for you to do what’s right

    2007 Nissan Pathfinder…at 102k miles the heat went out and it wasn’t until I checked the coolant that I realized there was a bigger problem. Had the radiator replaced (on my dime), and both systems flushed. It now has 129k miles, and the transmission just went out. I’m aware of the attempted class action lawsuit and know there is nothing Nissan will do, but like many others I will not be buying another one. Shame on Nissan for not recalling these vehicles for faulty radiators. I’ve seen recalls for much less…

    I’ll never own another one!!

    i also have a 2007 xterra w/ 117,000 and mine just blew up w/ the transmission and radiator issue that has a class action suit against it. Nissan has basically said ‘screw you’ won’t help w/ any of it. I loved my Nissan till this happened and knowing that they are knowingly screwing people….I will never buy another Nissan again.

    From Texas bought a 2007 Nissan xterra 2 years ago and has now 120,000 miles and took to shop Nissan Mcgavock and they could not fix with flushing the radiator or transmission so they quoted me $5800.00 to replace transmission and radiator. could not afford to fix the the Xterra now it is sitting at a buddy shop hope to save money to buy new transmission please help me this is my daughters car and she does not have a car anymore…

    You can add another who will never buy another Nissan. Bought a 2007 Xterra. Didn’t get 100 miles on it when the transmission went out. The dealer offered to buy another used transmission if we paid for the install. Paid $2,000.00, then less than 500 miles and the used transmission has gone out. With tow bills, transmission and cost of the Xterra I now have over $10,000.00 wrapped up in a vehicle that doesn’t run. This piece of crap can sit in the driveway till hell freezes over. I won’t put another dime into it and I will be sure to tell everyone what I think of a Nissan. Anti freeze in the transmission, that should never ever happen. What a poor design.

    We just had this happen to us. 124000 miles, 10 years and the radiator is leaking into the transmission. We are out $5000K and Nissan will not give us a dime. We are let everyone we know what happened to us, this is our 4th Nissan. We will NEVER buy another one. What a rip off – the settlement is unfair!

      I have the same issue. I will never by a Nissan again! Nissan should be banned from selling their crappy vehicles in the United States.
