Nissan CVT Defect Class Action Lawsuit Overview: 

  • Who: Minerva Martinez filed a class action lawsuit against Nissan North America Inc. 
  • Why: Martinez claims Nissan sold model year 2017-18 Nissan Altima and Sentra vehicles containing defective continuously variable transmissions.
  • Where: The class action lawsuit was filed in California federal court.

Nissan North America manufactured and sold model year 2017-18 Nissan Altima and Sentra vehicles containing defective continuously variable transmissions (CVTs), a new class action lawsuit alleges. 

Plaintiff Minerva Martinez claims Nissan fails to disclose the issue to drivers who are left with vehicles prone to overheating due to the alleged defect. 

Nissan manufactured the CVTs with an “inadequate cooling system” that “fails to properly regulate the temperature in the fluid which lubricates all the components of the CVT,” according to the class action lawsuit. 

Martinez wants to represent a nationwide class of consumers who purchased or leased a 2017-18 Nissan Altima or Sentra, along with a subclass of drivers who purchased or leased an affected vehicle in Nevada. 

Martinez says she began to experience issues with her new 2017 Nissan Altima shortly after purchasing the vehicle, including losses of power and a failure to accelerate. 

Martinez claims there was no mention of the CVT defect when she purchased the vehicle, which she says was marketed to her by a salesperson as having a “smooth ride” and a “powerful engine.” 

Nissan Did Not Solve Issue, Mischaracterized Service Records, Plaintiff Claims

Despite multiple attempts to have her vehicle’s CVT fixed at Nissan dealerships, Martinez claims the defect, which she argues also puts drivers at risk, was not solved and is still causing her problems. 

Martinez claims that Nissan even mischaracterized one of her service records as being a brake issue while simultaneously refusing to “diagnose or attempt to repair the transmission safety issue.” 

Martinez claims Nissan is guilty of breach of express warranty and unjust enrichment and in violation of the Nevada Deceptive Trade Practices Act

Plaintiff is demanding a jury trial and requesting relief in the form of compensatory, statutory and exemplary damages for herself and all class members. 

Last month, Nissan agreed to pay $277.7 million to end claims it sold certain Rogue, Pathfinder and Infiniti QX60 vehicles with defective CVTs

    I purchased a brand new 2017 Nissan Altima from the dealership. At the time of purchase it had brake issues, which were never corrected before the warranty expired. Now I am having Transmission issues, I will loose power when driving, or go to take off from a stopped position and the car will not get any power or move.

      I myself am having the same issue. My Nissan Sentra 2017 stalled out. I turned vehicle on try to change gears and go but it takes time and then quickly gets power to move. The dealer Saud Nissan refuses to cover costs for repair. Meanwhile I’m unable to pay for this costly repair. Now trying to figurevout how to get another vehicle cause loosing time off work isn’t helping me.

    I purchased a 2017 Nissan Sentra brand new, in March of 23, the transmission went out no warning at all. I was told by Nissan that there wasn’t anything they could do or would do bc I was over the warranty mileage. Never once heard about transmission issues in these vehicles. So frustrating!!

    My mother in law paid off her Nissan Altima 2017. The same issue everyone is reporting about it is occurring. Even the dealer that sold it doesn’t want to fix the issue. Please sign us up as well!! How can you pay off a new car and have to deal with this expensive repair.

    Purchased my Nissan Altima (2018) in Jacksonville Florida-2019/August The dealership Filed Bancruptcy during Covid, and no longer exist, and warranty has expired for me. Since 1/2023 I noticed that the power of vehicle, and acceleration was off, but as off recently it is slightly jerking and faint burning smell. I am now relocated in Charlotte,NC (also no longer Work from Home) so I am more in tune with these issues, as I drive everyday to work. A reputable mechanic was not able to check Trans fluid as it has to go to dealer to access. He however drove the car and guaranteed me that it appears to be transmission issues. This is a nightmare I would love to be added to the RECALL LIST!

    2018 Nissan Altima. Transmission started losing power and acceleration, and no shifting. Finally Ck Engine light comes on. Dealer charged me $4975.00 and no help.
    Had to do it, it’s my kids car and he just moved out on his own. This is a very dangerous situation and just a matter of time before a terrible accident happens from this issue and the results could be catastrophic for someone. Recall should be mandated immediately. Come on Nissan you can do better !!!! Recall-Sign me up !!!!!

    I live in Ontario, Canada and the same issue with my 2018 Nissan Sentra SV! When starting the car sometimes it does not work, no matter the weather. When on the highway accelerating it gives issues, like the car is trying to move fast but it doesn’t. I have to fully take my foot off the gas and try to put my foot down again to see if it can catch. Keeping in mind the car is shaking like crazy. It shakes even when I am slowing down of in traffic. As well randomly vibrates like crazy while sitting at a traffic light. The most recent situation is my car turned on, then turned off on its own, but the car was still running? I am not sure why this is possible + There is has been multiple times where my dash has lit up like a Christmas tree. In addition, I showed the car technician that the car has a starter and showed him how I found out by double pressing the lock button, and he was confused because when they checked my car they indicated it had no starter, and I was then told “I guess you got lucky”. I went back multiple times to the Nissan Dealership and they wanted me to pay $500 for just an inspection of the transmission which was the cost for a basic inspection, and informed that if something was wrong there would have been a recall. They practically said oh well, the guy who sold you the car is currently unavailable. They then informed they can no longer help.

    Same issues as all others. 2017 Altima — tranny issues at 50K miles. I would absolutely agree to join a class pursuing Nissan for the CVT issues that have long plagued their vehicles.

    I also bought a 2017 nissan sentra and have had transmission issues ever since and now the transmission is completely out of order and now I’m stuck with no car and can’t even afford transmission repairs

    Brought 2017 Nissan sentra in 2020 at 69000miles now at 138000 and transmission is utter garbage with 9700 left to pay on loan I’m in financial hell…Can’t even afford to Fix the transmission…please add me to the class action suit immediately

      I have a 2018 nissan sentra transmission went on it dealer verify it and they are making pay 4800 to get my car
