Nissan will pay $277.7 million as part of a settlement resolving class action lawsuit claims certain vehicles were equipped with a defective continuously variable transmission, or CVT.

The settlement agreement benefits a nationwide Class of owners and lessees of the following vehicle models:

  • 2014 to 2018 Nissan Rogue
  • 2015 to 2018 Nissan Pathfinder
  • 2015 to 2018 Infiniti QX60

Nissan owns both the Nissan and Infiniti automotive brands. Vehicles from these brands are sold around the country but, according to class action lawsuits, may not be as reliable as customers expect.

Plaintiffs in the Nissan transmission class action lawsuit contend their vehicles suffered from defects originating in the CVT. The CVTs used in Nissan Rogues and other vehicles allegedly cause poor transmission performance, shuddering and shaking, and even complete transmission failure.

The class action lawsuit accused Nissan of knowing about the CVT problem for years due to numerous complaints to the company and to the National Highway Transportation Safety Authority (NHTSA). Instead of taking action, Nissan allegedly failed to warn customers or fix the problem. 

Owners and lessees were allegedly forced to pay “exorbitant” costs to repair the CVTs. In some cases, transmissions allegedly needed several repairs.

Nissan has not admitted any wrongdoing but agreed to pay $277.7 million to resolve the claims.

All settlement Class Members are eligible for a new vehicle limited warranty extension under the Nissan transmission class action settlement deal. This benefit extends the warranty on Class vehicles by 24 months or 24,000 miles — whichever comes first. 

For Nissan vehicles, the original warranty covered 60 months or 60,000 miles. With the extension, the Nissan new vehicle limited warranty covers 84 months or 84,000 miles.

For Infinity vehicles, the original warranty covered 72 months or 72,000 miles. With the extension, the Infinity new vehicle limited warranty covers 96 months or 96,000 miles.

In addition to extending vehicle warranties, the Nissan CVT settlement provides cash reimbursement for owners or lessees who had to pay for transmission repairs out of pocket after their warranty expires. 

If the repairs fell within the new warranty time period, Class Members can collect up to $5,000. 

However, if the repairs occurred outside of the extended warranty period, consumers are not eligible for payment.

The deadline for exclusion and objection is Feb. 22, 2022. 

Although the Nissan transmission class action settlement deal was awarded preliminary approval on Oct. 13, 2021, the court still needs to make a final decision about the settlement’s fairness. The final approval hearing for the settlement is scheduled for March 21, 2022.

In order to receive repair reimbursement under the Nissan CVT class action lawsuit nsettlement, Class Members must submit a valid claim form by March 22, 2022, or 30 days after their qualifying transmission repair — whichever date is later.

Who’s Eligible

Nationwide Class of owners and lessees of the following vehicle models:

  • 2014 to 2018 Nissan Rogue
  • 2015 to 2018 Nissan Pathfinder
  • 2015 to 2018 Infiniti QX60

Up to $5,000

However, if the repairs occurred outside of the extended warranty period, consumers are not eligible for payment.

Proof of Purchase

If you have documentation showing the replacement or repair was to the transmission assembly (including torque converter and/or valve body) or automatic transmission control unit (ATCU) in your vehicle, please submit an original or true and correct copy of documentation created by an authorized Nissan or Infiniti dealer or other non-Nissan/Infiniti automotive repair facility at or around the time of the replacement or repair, that includes your vehicle’s VIN, proof you paid out of pocket in whole or in part for the replacement or repair, the amount you paid for the replacement or repair, the vehicle’s mileage at the time of replacement or repair, and the date of replacement or repair to your vehicle.If the replacement or repair was performed after the mileage and durational limits of the warranty extension as applicable to the vehicle, and you have documentation showing  an authorized Nissan or Infiniti dealer previously diagnosed and recommended replacement or repair to your transmission or ATCU when your vehicle was within the mileage and durational limits of the warranty extension, submit — in addition to the documentation requested above —  include an original or true and correct copy of documentation created by the authorized dealer at or near the time of the diagnosis and recommendation that includes the following information: the authorized Nissan or Infiniti dealer diagnosed and recommended a replacement or repair to the transmission assembly (including torque converter and/or valve body) or ATCU in your vehicle, your vehicle’s VIN, the vehicle’s mileage at the time of the dealer’s diagnosis and recommendation, and the date of the dealer’s diagnosis and recommendation.

    Thank you for the info. My 2014 Nissan pathfinder transmission went out less than 70,000.miles $6718.70 to replace transmission. Plus back gate doesn’t work.

    Thank you I just just wrote a letter to the judge too and I I let my attorney to contact the judge to and will go after them next I lost over then $12000 for 2 transmission repair I gat 4 emails first they say my claim is denied 2 emails say my claim is valid and payment will be processed 3 months later I send emails when I will receive my payment they say my claim is denied I was like ohh my god they set at the office and say your documents is not original I say I copied all my documents and scanned to upload it to my computer then I fill a claim yes the documents don’t look like the one I have on my hand the only thing is missing from the document I uploaded to my computer is the cooler that’s all they say send us the credit card statement that bay for the repair I say okay here you go I send it they get everything they ask for and now they say call us 4 to 3 months to know if your claim okay I was like so the one is sending the email have no power to make decisions on claim you not getting the same answer every times you send email because they don’t answer the phone and they reply on your email if you get reply after a month ore 2 the attorney get his money after every one file claim and show it to the judge and that’s why they get the money because off us

      OMG AMY!!

      The same thing happened to me!!!

      I have a 2018 Rogue, it was repaired at 65,000 miles which is within the warranty time frame, I submitted a copy of the repair and credit card receipt within 30 days of the repair and they just emailed me saying I was denied!!! They said proof of payment not sufficient!! They are robbing us.

      Amy, can you please tell your lawyer that many people are getting wrongfully denied. I can’t afford an attorney. Please tell your lawyer to force the settlement admin to re-review the claims they wrongfully denied. The settlement admin is a criminal!!

    i just wrote a letter to the judge too. I submitted proof the repair and proof of payment and the settlement admin still denied me for “proof not sufficient”. You were right about them denying everyone… The settlement admin is using deceptive business practices.. Im glad I mailed my letter to the judge.

    They say proof not sufficient the same things about my claim and never send notice say what more they need I don’t know what that mean ore what they need all the attorneys get bay and the administration is making more money and after all claims is on court records that’s why they get o proved buy the court one day they say my claim is okay and ready for payment the week after they say my claim is denied we lost more then $ 8000 for pic shit car and now they don’t want bay us

      Amy,
      You need to write to the judge!! the settlement admin is denying EVERYONE, not just you. They denied me too. You need to write to the judge so he can fix your claim. Make sure you write to the judge how shady these settlement admins are. Stop wasting time and send a letter to the judge now. I wrote to him 2 months ago and now my claim is approved.
      To all of the newcomers on here, this message is for you too. If you got denied, then WRITE A LETTER TO THE JUDGE!! the more people write to him, then there higher chance everyone will be approved…..

    EVERYONE LISTEN UP!!
    I just found out that the settlement admin is DENYING almost everyone. I submitted my mechanic repair invoice AND credit card receipt and they denied my claim over a B$ reason.. They said “proof not sufficient”. I mean, what kind of B$ is that??? What else would I need to submit? Do I need to include a video footage of the transaction taking place? My car is a 2018 and had 65k miles on it, so my car does quality.

    I have heard on facebook that many other people are reporting the same thing. The settlement admin wants to DENY everyone. They have no intention of paying us. We need to contact the COURT. We need to expose the shady things the settlement admin is doing. Here is the information of the court and judge. Contact them now. We all need to call them. Power is in numbers.

      My 2016 Altima just randomly started and check engine just came in today with codes and shuddering code. My Altima has 59300 miles and I’ve owned since new. This is not fair that Nissan could put these transmissions and now we have to suffer on cars that are still practically new!

    I have a 2016 Nissan Altima I’ve been having problems with my car since the day I got it and I’ve been giving the runaround I tried to return it before 30 days and they still couldn’t find anything wrong with it right now I’m having problems with the lights my windows won’t go down everything please contact me
