Nissan, Infiniti class action overview: 

  • Who: A Nissan vehicle owner sued the automaker.
  • Why: The plaintiff says Nissan made a range of Nissan and Infiniti vehicles with obsolete technology that does not allow them to connect to the internet. 
  • Where: The Infiniti and Nissan class action lawsuit was filed in a Tennessee federal court.

Nissan fitted some of its Nissan and Infiniti branded vehicles with obsolete 3G modem technology that rendered many of their online features useless, a new class action lawsuit alleges.

Plaintiff George Schwarz filed the class action lawsuit against Nissan North America on Nov. 16 in a Tennessee federal court, alleging violations of state and federal consumer laws.

According to the lawsuit, Nissan and Infiniti’s internet-enabled features, such as a stolen vehicle locator, remote lights, remote vehicle unlocking, horn activation and automatic crash notifications, are now unusable for drivers.

This is because Nissan outfitted many of its vehicles with old technology “rendered inoperable after AT&T’s 3G phase out in 2022,” the Infiniti and Nissan class action alleges.

Nissan refuses to fix affected vehicles, class action alleges

Schwarz says he bought two of the affected vehicles, a 2016 Nissan Maxima Platinum and a 2017 Nissan Murano Platinum.

Around March 2022, he says he noticed his NissanConnect Services were not working. 

Upon startup, his vehicles’ consoles showed a screen asking him if he would like to connect to NissanConnect. Even when he selects “yes,” the car icon in the upper right-hand corner of the telematics screen shows a red line indicating a lack of data connection, the Infiniti and Nissan lawsuit states.

Schwarz estimates he contacted Nissan about the problem about 20 times but is still unable to use the online services and receives the same error screen upon startup.

He says Nissan refused to offer any repair or upgrade to the online services. As a result, Schwarz says the vehicles were falsely marketed and that he overpaid for his vehicles.

“Nissan’s warranty or owner’s manual for the vehicles makes no mention of the fact that Nissan installed an inferior 3G modem in them,” the Nissan and Infiniti lawsuit states.

Schwarz seeks to represent a nationwide class of people who leased one of the class vehicles:

  • Leaf, model years 2016 and 2017
  • Altima, model years 2016 and 2017
  • GT-R, model years 2017 and 2018
  • Maxima, model years 2016 and 2017
  • Murano, model year 2017
  • Pathfinder, model year 2017
  • Rogue, model years 2016 and 2017
  • Rogue Sport, model years 2017 and 2018
  • Sentra, model years 2016 to 2018
  • Titan, model years 2016 and 2017
  • Titan XD, model year 2017
  • Infiniti Q50, model years 2014 to 2018
  • Infiniti Q60, model years 2017 and 2018
  • Infiniti Q70, model years 2013 to 2018
  • Infiniti QX30, model years 2017 to 2019
  • Infiniti JX, model years 2013 to 2017
  • Infiniti QX60, model years 2013 to 2017
  • Infiniti QX56, model years 2013 to 2017
  • Infiniti QX80, model years 2013 to 2017

He also seeks to represent a New York class.

Schwarz sued for breach of warranty, fraudulent omission and unjust enrichment and seeks certification of the class action, damages, fees, costs and a jury trial. 

Consumers have recently filed several class action lawsuits against automakers for similar issues.
