Nissan

Nissan has been hit with a class action lawsuit for hiding the fact that certain 2004-2006 Nissan Armada and Titan Trucks and Infinity QX56 vehicles contain an allegedly faulty and defective Delta Stroke Sensor, an integral electronic component that controls certain safety aspects of braking.

According to the Nissan class action lawsuit, these affected vehicles “post a significant and immediate safety threat to all users of such vehicles and to the public in general” because “the failure of this defective part results in the braking ability of affected vehicles being disabled to the point where drivers are, without warning and suddenly, unable to stop their vehicle within a reasonably safe time and distance, or at all.”

The lead plaintiff in the case, titled Brandon Banks and Erin Banks v. Nissan North America, Inc., et al., claims that as a result of the failure of the defective Delta Stroke Sensor in their Nissan, she drove through a red light in a busy intersection with her small children in the car because she was unable to brake the car. Thankfully, no collision occurred.

The class action lawsuit further alleges that Nissan knows about the defective part but hides it from consumers and fails to disclose the critical safety defect or issue a voluntary recall of affected Nissan Armada and Titan Trucks and Infinity QX56 vehicles.

The Nissan class action lawsuit is brought on behalf of a proposed class of all U.S. residents who currently own a 2004-2006 Nissan Armada and Titan Trucks or Infinity QX56 or who do not presently own an affected vehicle but incurred monetary loss caused by the failure of the Delta Stroke Sensor, including repair or replacement and other financial loss associated with such failure. It is seeking restitution and recovery of out-of-pocket repair costs, damages, and other relief.

    I have a 08 armada and I have had the same problem for a year now. It only does it every couple months and when I turn the car off it resets and stops. The dealership just keeps saying I needed new brakes! This is very dangerous. I received a letter a couple weeks ago saying that if you had this problem and have already had it fixed they would pay you back. Mine is not fixed. They should do recall. Has anyone else got the same letter?

    Tengo el mismo problema con mi armada del 2004 me quedo sin presión en los frenos la apagó y la vuelvo a encender y se le va el problema ya e gastado mucho dinero dos veces le e cambiado el cilindro mastro y nada el la nissan cobran 115 dolares la hora solo por mirarlo

    This happens to our Armada every few months. Twice this mopnth. Loss of breaking power, ABS light on, grinding noise. Turn off & on & it clears. I dont have $1K to replace the delta stroke sensor & really dont think we should be getting something like $20 from the class action settlement. This should be fixed as a recall by Nissan at no charge. How can the courts agree to a settlement & only if you spent the $1K to get it fixed & have documentation of the repair can you claim their $20 settlement offer? Lawyers getting rich, we all get squat. The court should require a recall for many like me who still have the vehicle but cant spend the $1K to fix it, & assure a full reimbursement to all who already paid the $1K.

    Wow as am seeing all of this makes me think that this is probably why I had the accident on my 2005 armada. How can I start a claim or who can I call.? I don’t have the vehicle anymore it was a total loss really bad accident. The SUV wouldn’t stop at all.! Please if anyone as any info I really appreciated.!

    This morning I was driving and all of sudden I saw the \slip\ lights sign in my dashboard.

    I was turning left when this happened and just driving slowly. If not it could be a major accident for I couldn’t control the steering wheel and the break stopped for a few seconds.

    I went home and used my wife’s car today.

    I contacted Nissan Consumer Affairs after reading they had settled the suit to see if they would finally admit the issue with the brakes and fix them and they denied the claim. Looks like Nissan still wont step up and do the right thing when it comes to fixing the braking systems on these cars.

    We just bought a pre-owned 2005 Infiniti QX56. It has 104k miles on it and runs like a top. It had only one owner who took great care of it. But, soon after we bought it my wife was driving through town with the kids in the back seat, and when she pumped the brakes, the brake light came on and the pedal started to stutter as if the ABS was preventing her from depressing the pedal fully. Then, once that stopped, the pedal went all the way to the floor and she nursed it home where I immediately took it back to the dealership where they determined that the master cylinder was bad and that the brake booster needed to be replaced…$1250 later it seems to be working fine. But now that I see this class action suit I’d like to find out if there’s a way for me to get reimbursed, even if just partly. Does anyone know how I could file a claim against this suit?

    I bought my titan new in 2006. I only have 48,000 miles on the truck now, so i dont drive it that often. I have always had brakeing problems with it and had new brakes installed to see if it would help. I did not have any luck with that. Would appreciate any information you can offer. Thanks.
