Nissan class action lawsuit

A settlement has been proposed in a class action lawsuit alleging Nissan North America Inc. failed to notify consumers that the failure of a brake booster component in certain Nissan and Infiniti vehicles could cause a reduction in braking power.

If you owned or leased a model year 2004-2008 Nisan Titan (with VDC), Nissan Armada or Infiniti QX56, you may be entitled to benefits from the Nissan class action settlement.

The Nissan brake defect class action lawsuit accuses the car maker of failing to notify consumers that the failure of the Delta Stroke Sensor (DSS), a component in the brake booster in certain Nissan and Infiniti vehicles, could reduce the braking power in affected vehicles. The brake booster with DSS at issue in this Nissan class action lawsuit was reportedly manufactured by Continental Automotive Systems Inc.

Nissan and Continental Automotive Systems deny the allegations and maintain that the driver would have sufficient braking power even in the unlikely event of a DSS failure. However, they have agreed to settle the Nissan class action lawsuit to avoid the expense and risk of litigation.

The proposed Nissan settlement provides a number of benefits to eligible Class Members, including partial reimbursement for out-of-pocket costs incurred for repairing the active brake booster and/or VDC control unit.

If you would like to object to or exclude yourself from the Nissan DSS class action settlement, you must do so no later than Aug. 19, 2016.

Who’s Eligible

Class Members include U.S. residents who currently own or lease, or who previously owned or leased, a model year 2004-2008 Nissan Titan (equipped with VDC), Nissan Armada, or Infiniti QX56 vehicle.

Potential Award

Up to $800.

The amount each Class Member is eligible to receive from the Nissan brake defect settlement depends on the mileage at the time of repair of the DSS issue. The settlement offers a partial reimbursement for the out-of-pocket costs associated with repairing or replacing the active brake booster and/or VDC control unit.

Proof of Purchase

Class Members must provide documentation reflecting the specific C1179 diagnostic code associated with the DSS issue, proof that the out-of-pocket expenses were actually paid by the Class Member, and proof that the Class Member owned or leased the vehicle at the time of repair of the DSS issue.

    I own a 2004 Nissan Armada and since I got it I have had issues with the brake light going on and causing my brakes to malfunction. I took it to the dealer back in 2016 and all I was told is that the vehicle was fine. I rarely used this vehicle back then. So, I didn’t take consideration into checking else where because I trusted the dealer.
    Time passed and I gave my newer vehicle to my son and was left with using my armada. I noticed the problem of the manual brake was still coming back and more frequently than normal.
    2 weeks ago I had a panic attack when I was driving on the freeway and the light went on. As I tried braking all I would hear was grinding. I had to push on the brakes multiple times little by little with the grinding still occurring to try and get to the nearest exit to turn of the vehicle and turn it back on.
    This sometimes works to erase the brake light, but it isn’t always the answer to it. As, the brake light turns right on again.
    I’m so upset when I found out that this issue has been occurring to multiple Nissan armadas- titan.

    Fix these defective Delta Stroke Sensor before another life is taken!!!

    In Vegas there was a deadly crash due to this Delta Stroke Sensor not working and unfortunately 3 people lost there lives.

    I purchased my 08 Nissan Armada with 80000 miles on 2018. I had no idea about this lawsuit. I know now from researching brake issues I’m having. Is it too late to have Nissan fix this problem?

    I own 2 Armadas and the one is having the braking issue now. I’d like to have this taken care of this issue. If Nissan knows about all the issues occurring, I believe their should be a recall on these vehicles.

    I never got my booster replaced. I e had the sudden loss of braking power happen to me about 4-5 times. It’s very scary bit never had the money to get it fixed. Is there anything we can do. I tried to start a class action 2011 but lawyer never got back to me

    Can I still file a claim I have 2004 Infiniti QX56 recently I just have the same problem on the brake it seems the front end are grinding metal to metal and it’s hard to stop can you please help thank you.

      I receive their first notice on 2016 I register never got back anything I received a second notice 2017 I haven’t heard anything since then 2005 Nissan armada I do experience the problem
