Nissan has been hit with a class action lawsuit for hiding the fact that certain 2004-2006 Nissan Armada and Titan Trucks and Infinity QX56 vehicles contain an allegedly faulty and defective Delta Stroke Sensor, an integral electronic component that controls certain safety aspects of braking.
According to the Nissan class action lawsuit, these affected vehicles “post a significant and immediate safety threat to all users of such vehicles and to the public in general” because “the failure of this defective part results in the braking ability of affected vehicles being disabled to the point where drivers are, without warning and suddenly, unable to stop their vehicle within a reasonably safe time and distance, or at all.”
The lead plaintiff in the case, titled Brandon Banks and Erin Banks v. Nissan North America, Inc., et al., claims that as a result of the failure of the defective Delta Stroke Sensor in their Nissan, she drove through a red light in a busy intersection with her small children in the car because she was unable to brake the car. Thankfully, no collision occurred.
The class action lawsuit further alleges that Nissan knows about the defective part but hides it from consumers and fails to disclose the critical safety defect or issue a voluntary recall of affected Nissan Armada and Titan Trucks and Infinity QX56 vehicles.
The Nissan class action lawsuit is brought on behalf of a proposed class of all U.S. residents who currently own a 2004-2006 Nissan Armada and Titan Trucks or Infinity QX56 or who do not presently own an affected vehicle but incurred monetary loss caused by the failure of the Delta Stroke Sensor, including repair or replacement and other financial loss associated with such failure. It is seeking restitution and recovery of out-of-pocket repair costs, damages, and other relief.

Pt 1 of 2 Wow, I posted previously on 9/16/11 and I’m amazed at how many more people this is happening to. This is not even everyone, these are just yhe people writting about it on classaction. Well heres an update from me. I did read through all the pages of the lawsuit that was filed by Brandon and Erin Banks, and I did contact their lawyer who is handling the class action lawsuit. they took a verbal statement from me, and also asked for a written one. They also asked that if I pay for any replacements on this delta stroke sensor thing that seems to be the cause of this death trap, that I should keep and send them a copy of the receipts, as well as the part its self, I was advised to tell the dealership that I want to keep the part if I pay to have it replaced.
I have the same intermittent problem with my wives ’05 Armada. The dealer reprogrammed the VDC module but that didn’t help. When I took it back they said the brake booster has a bad sensor but is only sold as a complete unit. Of course by then I was out of warranty. Why is there no safety recall?
My wife and I own a 2007 Nissan Armada, I was driving on a 45 MPH zone when all of the sudden I hear a loud clicking noise and then it happened. The rear brake line snapped and wrapped around the axle causing serious damage to our rear differential. Long story short warranty doesn’t cover break line. We refuse to drive the vehicle especially with our new born, NO WAY NO HOW. This is a death trap any faster and the vehicle could have flipped over.
i have a 2005 4×4 nissan titan. this loss of brake happens to me many time, brake light will come on while driving and if you push the brake you will hear a loud grinding noise on the left front, and pedal goes to the floor. turn off engine and start it again it will be good again, its intermitent, you dont know when will it happen, so i always look on my dash for the brake light while driving so i know that its doing again. no money to fix it yet.
I purchased a used 2005 QX56 from a reputable dealership in the area. I had the problem last Friday where I went to apply the brakes as I was approaching a red light and could not stop. I heard a large clanking sound and nothing. Thankfully I was going slow enough where I could actually stop. I am now terrified to actually drive the car especially with my 2 year old in the back seat. Is there anything that I can do? I feel like this is extremely unethical that a company can sell something like this when they know of these problems.
We began having trouble immediately after purchasing the vehicle. The “break”, “slip” and “VDC Off” lights would illuminate on the dash and the anti lock breaks would fire whenever you engaged the brake pedal. After numerous visits to the dealer, they claimed it was fixed. Recently we’ve begun having the same trouble again and they’ve just told me that the Pressure Sensor Circuit and Delta Sensor Circuit failed and needed to be replaced. The cost of the repair is 1180usd. I have no choice but to pay it, but I will definately be following up on this class action law suit.
Wow, I was just on my way home from work after stoping at a Mc Donalds for food for my daughter and I noticed the brake light was on. I pumped the emergency brake to make sure it wasn’t that, and it wasnt. Then as I approached the next light, coming into a school zone with the flashing lights telling me to go 15 miles per hour, I applied the brakes and notices I could not break. It felt as if the anti lock brake system had kicked in and was stopping me from braking normally. luckily there were no kids around but that was really scary. I also want to know how to get in on this class action lawsuit, did you find any information? because this is rediculous.

I have a 2005 Nissan Armada and I am going through the same issue. My kids were in the back when I went to stop at a red light and the breaks went out. I almost hit two people, to avoid hitting the people, I drove up on the curb and scared the death out of myself and my children. I took my truck to the dealer becauae I was afraid to drive it and they told me that I was going to have to pay for it because there was no recall which I dont understand. How can I get in on the class action suit?

I have a 2004 Nissan Armada that I purchased new and have been dealing with these same issues for 10 years now…And on some occasions have lost braking. How do I get into the class action suit?
Brake light came on while driving and braking made a bad noise. Scared the heck out of me. It does not feel safe driving it. I Should had bought a Toyota.
I own a 2005 Nissan Armada and have been experiencing the same braking problem described in this complaint since I bought the vehicle in 2005. Each time I take it in about the problem, they tell me that something needs adjusting. Then it’s okay for a few months sometimes up to a year, then suddenly without warning the brakes fail again. Here’s how it happens – as I press down on the brake, I notice that the emergency brake light comes on, then there a crunching sound as I apply the brake which then does not work at all. I then have to coast to a stop, put the car in park, and turn off the ignition, When I restart the ignition, the emergency brake light goes off ans I can return to driving. I have been very fortunate to date that I have not hit any other vehicles or worse any person because of this braking problem. Please let me know ASAP how to be a part of this Class Action suit. If this problem is not resolved soon, someone is going to get seriously hurt!

Just happened to me today approx. 1030 March 24, 2016. Driving my 2005 Nissan Armada LE. The mechanic after visually and driving my vehicle stated its the ABS module. Nissan SUVs all having this problem, even the little SUV. HOW do I get involved with this Class Action?
The same thing is happening to me it has happened probably five or six times total since I’ve had the vehicle my brake light will come on I want to go to stop I can’t stop I’ve almost been an accident four times I have to shut my car off and let it sit for a few seconds I turn it on and I’m able to drive but how scary three out of the four times I had all my kids in the car the other time I had 2 of my kids in the car I cant afford the 900 to replace the brake booster or whatever it is I don’t know what to do I feel like become part of the class action lawsuit they should just pay us so that we can get it fixed
