Nissan

Nissan has been hit with a class action lawsuit for hiding the fact that certain 2004-2006 Nissan Armada and Titan Trucks and Infinity QX56 vehicles contain an allegedly faulty and defective Delta Stroke Sensor, an integral electronic component that controls certain safety aspects of braking.

According to the Nissan class action lawsuit, these affected vehicles “post a significant and immediate safety threat to all users of such vehicles and to the public in general” because “the failure of this defective part results in the braking ability of affected vehicles being disabled to the point where drivers are, without warning and suddenly, unable to stop their vehicle within a reasonably safe time and distance, or at all.”

The lead plaintiff in the case, titled Brandon Banks and Erin Banks v. Nissan North America, Inc., et al., claims that as a result of the failure of the defective Delta Stroke Sensor in their Nissan, she drove through a red light in a busy intersection with her small children in the car because she was unable to brake the car. Thankfully, no collision occurred.

The class action lawsuit further alleges that Nissan knows about the defective part but hides it from consumers and fails to disclose the critical safety defect or issue a voluntary recall of affected Nissan Armada and Titan Trucks and Infinity QX56 vehicles.

The Nissan class action lawsuit is brought on behalf of a proposed class of all U.S. residents who currently own a 2004-2006 Nissan Armada and Titan Trucks or Infinity QX56 or who do not presently own an affected vehicle but incurred monetary loss caused by the failure of the Delta Stroke Sensor, including repair or replacement and other financial loss associated with such failure. It is seeking restitution and recovery of out-of-pocket repair costs, damages, and other relief.

    I have had this problem since I bought my 2004 Titan new. when you tell the dealer they don’t know what your talking about and want to charge you 100 dollars just to look at it. They replaced the rotors at 10000 miles but the problem continues to this day. Truck now has 123000 and you never know when the brake light will come on and brakes will shutter, it always at low speed 25 to 35mph. so we just stop and turn it off and on and it runs great. I also have rear end seal problem. Would like to know what’s happening in the class action suits.

    Driving my 2005 Armada with 119,000 down a city street this weekend and went to stop at a red light, brake light came on, brake pedal practically sank to the floor and the brakes were grinding with very little grip, stopped just short of entering the intersection. Pulled into a nearby parking lot and turned the car off. checked under the hood, no fluids, leaking etc, started it up again and brake light turned off and brakes working again. I thought it was the master cylinder on its way out. Happened to be very close to a Big O tires shop I frequent, they checked the internal computer system code and said it was the Delta Sensor Brake Booster and that I needed to take to dealer as there was some type of lawsuit going on over the issue. Took the printed receipt from Big O Tires (with the error codes on it) and drove it carefully to the Nissan dealership, they said they had to do thier own diagnostics, surprise they came up with the same thing $110 dollars later. Dealer said it was not covered by Nissan with a recall. End game is quote for $960 dollars to replace the brake booster…I can’t believe Nissan is not owning up to this with a recall. Kudos to Big O Tires, they were extremely helpful and even did the online research and informed me about the class action lawsuit info.

    Terrified to drive my Infinity 2006 QX56. I have experienced multiple near death car accidents. I have been dealing with this problem for about a year. Was told it was the brakes (changed them), was told it was the rotors (changed them), was told it was the master cylinder (changed it) with no resolve. Problems still exists. Finally, Infinity admits its a malfunction in my Delta Senor. Malfunction to me sounds like a defective part and that is not my $1500 bullet to bite!

    I have a 2004 Infiniti QX56 and have had this happen multiple times in the three years I have owned this vehicle. I am in Canada, don’t think I am able to join the lawsuit unfortunately!!

    I just bought a 2006 LE with 125,000 and was unaware of the problems with the brake system. Now I feel that I have put my family at risk by not doing homework on a reputable car manufacture. Shame on me. Shame on Nissan. Can anyone tell me if there is a way to track the progress of a possible recall or what action I should take. I bought the vehicle from a reputable friend and I hope they were honest when they told me that the brakes never failed, but just grabbed on the left front tire.     I have had the same issue (about 24 times thus far) with our 2006 Nissan Armada LE and made some called including Nissan of North America. I now see a class action suit and would like to learn more about it. Who can I contact?

    I own a QX56 2006. The same issue just happened to me. The break light would suddenly come on on its own and I can feel the parking break engaged suddenly. Once I tried to brake, barely pressing it the pedal down, the car would come to a sudden stop. Fortunately it did stop. Turns out the Brake booster needed to be replaced. Over $1200. This seems to be more of a safety issue that needs to be addressed. The dealership AND Infiniti consumer affairs reps claim they’ve never heard of this issue before.       I have a 2005 infiniti QX56 and am also having the same problem.But yesterday unfortunately my husband got into a car accident and hit a smaller vehicle in front of him. We called infiniti last year customer solutions and were informed to take it to infiniti to service it and had them do some work on it with sensors. this vechile is very dangerous to operate and you never no when its going to happen. Called infiniti yesterday and told them that this time we got in a car wreck still waiting on a case manager to contact me and take of this issue. going to talk to a lawyer /

    I have a 2007 Nissan armada le 126000 miles I was driving the truck (Monday june 30 2014) going to work and I notice the brake light comes on while driving. so I started driving slowly. I tried to push the brake and I hear a loud grinding noise on the left front, and pedal goes to the floor. Same thing when you turn it off the ignition it goes back to the normal operation. Is this truck still safe to drive or not?

    I have a 2004 QX56 with 154000 miles and it happen to my wife first the living hell out of her. I took it for a test drive and it happen to me no brake pressure. So I turn the car off and back on to reset the problem but we can not keep doing this. And at $1000.00to fix that is crazy.
