Nissan

Nissan has been hit with a class action lawsuit for hiding the fact that certain 2004-2006 Nissan Armada and Titan Trucks and Infinity QX56 vehicles contain an allegedly faulty and defective Delta Stroke Sensor, an integral electronic component that controls certain safety aspects of braking.

According to the Nissan class action lawsuit, these affected vehicles “post a significant and immediate safety threat to all users of such vehicles and to the public in general” because “the failure of this defective part results in the braking ability of affected vehicles being disabled to the point where drivers are, without warning and suddenly, unable to stop their vehicle within a reasonably safe time and distance, or at all.”

The lead plaintiff in the case, titled Brandon Banks and Erin Banks v. Nissan North America, Inc., et al., claims that as a result of the failure of the defective Delta Stroke Sensor in their Nissan, she drove through a red light in a busy intersection with her small children in the car because she was unable to brake the car. Thankfully, no collision occurred.

The class action lawsuit further alleges that Nissan knows about the defective part but hides it from consumers and fails to disclose the critical safety defect or issue a voluntary recall of affected Nissan Armada and Titan Trucks and Infinity QX56 vehicles.

The Nissan class action lawsuit is brought on behalf of a proposed class of all U.S. residents who currently own a 2004-2006 Nissan Armada and Titan Trucks or Infinity QX56 or who do not presently own an affected vehicle but incurred monetary loss caused by the failure of the Delta Stroke Sensor, including repair or replacement and other financial loss associated with such failure. It is seeking restitution and recovery of out-of-pocket repair costs, damages, and other relief.

      I have a 2005 Nissan Titan that’s having the same issue I hear a loud clunking noise coming from the front when I break. Sounds the same as when the truck slips on snow or ice except this is the summer and the roads are dry

    I bought a 2004 Infiniti QX56 in September 2014. I had no idea the car had issues with the brakes. Well, I found out. One night in December 2014 I rolled thru an intersection because I could not stop! For 25 miles I drove 20 miles an hour, with my emergency flashers on just trying to get home safely. My mechanic did not find a problem. Tomorrow (July 14, 2016) Im taking the car to my mechanic because there is a loud squealing high pitched, clanking noise coming from my rear, drivers side wheel. I need to be part of this law suit! I bought my car to drive, not to sit and look at it because I am afraid to drive it!

    I have owned my 2004 Titan for 10 years and it currently has 105,000 miles, living in Minnesota. Its been hard to document how many times this has occurred, I would say under 10 times however that’s 10 too many times. I have got it to reset by pulling over, turning off engine, and then restarting. Taking it to my mechanic when it has occurred has not been helpful as they have not been able to replicate it. The scenario is the same as others stated: grinding, mattress spring boing noises, stopping power estimated around 30%. I received a class action lawsuit postcard around June 23rd, 2016 which caused me to research this more only to find its the same issue I have been experiencing. Inquiries to local Nissan dealerships have not been successful as they haven’t heard of the DSS issue. I have not got this fixed but want to now. OF NOTE – TRUCKS ARE MADE TO TOW TRAILERS. I own a 22 foot fiberglass boat with motor – total weight is heavy. Its bad there is stopping issue with the truck alone, Im now more concerned about stopping while towing, which im sure most people also do with these trucks…TRUCKS ARE MEANT TO TOW. Will be interesting how this shakes out, I am wanting to get this repaired but its curious of the naivette of the local Minneapolis dealers of this issue.

    I just called the law firm representing the case. Unfortunately they said the deadline has passed for submitting a claim. The class is still pending though. Its such a shame that this issue is such a known critical issue but Nissan/infiniti has never intended to voluntarily solve it for its customers.     OMG! I found this site today only to be shocked at how many people had the same issue as I do. I own a 2005 Infiniti QX56 and we had exactly the same problem with brake last week. I called local Infiniti dealer to make an appointment for today and I brought the car in this morning. The service people people then told me the problem was caused by brake booster assembly and it needs to be replaced. I was quoted $1,067.00 to fix only this issue. I had no choice but to fix it because its so dangerous to drive such a big SUV with brake problem on the road. But now I am wondering if replacing the brake booster assembly would completely fix the issue. And also if this is such a known issue, why Nissan still charges its customers for replacing their defects and dont recall their products? Are they waiting for someone to get seriously hurt?

    I have a 2004 Nissan Armada and had the brake light come on yesterday followed by the limited braking, shuttering and pulsing of the brake pedal.. This is my third incident, it happen in year 2014, 2015 and Apr 29 2016. After Turn the car off and restart it, the brake light goes off then stops normally again. I have brought my Armada to Nissan dealership in MN. They charged me 130$ (diagnostic fee) and no problem solved. After research on internet after my third incident, I learned that thousands of people have experienced the same problem. There was a class action pending on this issues in state of California. Why NISSAN is ignoring this problem?. We are scared to drive this vehicle now, I have spent 40K to purchase this vehicle back in 2004. Please someone help resolve this issue.

    I have the exact same problem with my 2006 Armada. Will have to have it fixed in Mexico, thats where the car is right now. Will cost me 650 Canadian dollars to fix. I am do not feel safe driving the car any more and will have it fixed. Please let me know if there is a recourse against Nissan.

    Xq hace eso la nissan q no hay modo de sustituir ese sensor delta mi troka tiene prendido el vdc off,slip, abs que hago ya q vi todos estos comentarios quiero entregar mi troka aparte de esas tres luces el diferencial de atrás esta dañado puros problemas ayúdenme como puedo hacer la demanda estoy desesperado pa arreglarla me sale en 3150 dolares y todavía la estoy pagando
