A man has filed a lawsuit against Janssen Pharmaceuticals and parent company Johnson & Johnson as well as Mitsubishi Tanabe Pharma Court alleging their drug Invokana caused personal injury.
Plaintiff Earl P. of Missouri alleges in his lawsuit that he was injured by Invokana when shortly after taking the drug, he developed diabetic ketoacidosis.
In addition to being injured by Invokana, Earl states that he and others who took Invokana “have suffered and may continue to suffer severe and permanent personal injuries, including diabetic ketoacidosis, stroke, heart attack and severe kidney damage.”
Earl began taking Invokana in January 2015 and only used it for about a month before stopping the drug due to health concerns.
Invokana is a drug that is used to treat diabetes in patients. It is part of a class of drugs known as SGLT2 inhibitors.
These drugs are designed to prevent glucose reabsorption by the kidneys in order to lower blood glucose levels. Instead of the glucose being metabolized by the body, it is excreted through the kidneys of the patient.
“Defendants knew of a significant risk of diabetic ketoacidosis caused by the ingestion of Invokana. However, Defendants did not adequately and sufficiently warn consumers, including Plaintiff, or the medical community of the severity of such risks,” the Invokana lawsuit reads.
The lawsuit claims that the manufacturers of Invokana could have prevented health issues in those injured by Invokana, but instead those injuries were the direct result of “Defendants’ failure and refusal to conduct proper safety studies, failure to properly assess and publicize alarming safety signals, suppression of information revealing serious and life-threatening risks, willful wanton failure to provide adequate instructions, and willful misrepresentations concerning the nature and safety of Invokana.”
Michael says if he would have known that he would have been exposed to the risks posed by the ingestion of Invokana, including diabetic ketoacidosis, he would not have taken the medication and hence would not have been injured by Invokana.
“Plaintiff has endured pain and suffering, emotional distress, loss of enjoyment of life, and economic loss, including significant expenses for medical care and treatment which will continue in the future,” the complaint reads.
Michael claims that he has suffered from mental anguish after having received the knowledge that he may continue to suffer lifelong complications as a result of being injured by Invokana.
The Invokana lawsuit alleges that the manufacturers of the drug “actively concealed from Plaintiff and Plaintiff’s physicians and healthcare providers the true and significant risks with Invokana.”
Earl has brought forth a number of allegations against the manufacturers including: products liability act-manufacturing defect, defective design and failure to warn, breach of express warranty, negligence, breach of implied warranty, fraudulent misrepresentation, negligent misrepresentation, fraudulent concealment, fraud and punitive damages allegations.
As a result of allegedly being injured by Invokana, Earl is seeking compensatory damages in excess of $75,000, medical expenses and other economic damages, damages related to pain and suffering, pre-judgment interest, attorneys fees and additional relief as deemed proper by the court.
The Invokana Lawsuit is Case No. 3:2016-cv-05681, in the U.S. District Court for the District of New Jersey, Trenton Division.
In general, Invokana lawsuits are filed individually by each plaintiff and are not class actions.
