A class action lawsuit claims Chinese-made treats sold by Del Monte subsidiary Milo’s Kitchen kill dogs and make them sick.

The Milo’s Kitchen class action lawsuit was filed by dog-owner Lisa Mazur, who says her healthy 7-year-old dog, Riley Rae, suffered kidney failure and had to be euthanized after being fed Milo’s Kitchen Chicken Jerky Dog Treats. Mazur claims the only change in Riley Rae’s diet was during January 2012 when she fed the Chicken Jerky Dog Treats to her dog “on occasion.” On February 1, Riley Ray became ill and was taken to the vet, where she was diagnosed with kidney failure. Riley Rae was administered intravenous fluids for four days without improvement, forcing Mazur to euthanize her on February 5.

Mazur says she was unaware the Milo’s Kitchen chicken jerky dog treats made in China were included in a November 18, 2011 warning about dog illnesses associated with chicken jerky dog treats made in China.

“Defendants’ packaging did not warn of any dangers from feeding its content to dogs… [and] the warning is downplayed” on the Milo’s Kitchen website, the class action lawsuit says.

“Defendants knew that there was a substantial risk of death or harm associated with their dog treats. No reasonable person would feed dog treats to their dogs knowing that there was a substantial risk of death or illness from doing so,” the Milo’s Kitchen class action lawsuit continues. “Plaintiff, and other consumers, did not learn of the FDA warning, until after their dogs had consumed the treated and either became ill or passed away.

“Defendants intentionally concealed known facts concerning the safety of their dog treats in order to increase or maintain sales.”

This is not the first dog treat manufacturer to be hit with a class action lawsuit by a pet owner whose dog died after eating Chinese-made chicken jerky dog treats. A grieving pet owner filed a $5 million class action lawsuit against the makers of Waggin’ Train “Yam Good” dog treats in April 2012 after his 9-year-old Pomeranian became sick and died of kidney failure 11 days after eating the treats.

Mazur is seeking compensatory damages and punitive damages for a proposed class of all persons in the U.S. (except Louisiana and Puerto Rico) who purchased any dog treat product containing chicken jerky manufactured or sold by Del Monte or Milo’s Kitchen and containing chicken imported from China, within the past four years. She is alleging common law fraud, unjust enrichment, negligence, product liability, unfair trade, breach of warranty, failure to warn and defective manufacture or design.

    I also have had a sick dog with high vet bills after feeding her these treats and they still sell them in stores in my town. How can I get involved in this case to stop this from happening to other people and their pets. Please email me as soon as possible. Thanks

    my dog got sick about 6 weeks ago from eating the dog treats from sam club. the vet told me it was from eating the treats. allso sam club did away with them fast . they do not sell them now

    Why is this poisin still out on the market. My 5 yr old pup had kidney failure. We tested for everything possible with 2 different vets and had to put her Jan 2013. Why was this product allowed on the market with so many issues. They should be sued

    I am sorry to hear about everyones dogs here. I too am a dog owner and love my dog with all my heart. Unfortunately, this case here is not as it appears. I personally know these people who have sued the dog food company. These folks did not loose their dog from dog treats, he was old and it was his time to go. These people have made an unfortunate hobby of suing other people. They have sued their own family memebers, and recently the sued a well known single mother in our community. They no longer have found suing the “little guys” is of any satisfaction and now are going after “bigger” and better—where the real money is at. This has been going on with these people for years. PLEASE beware sending condolences…………..

    My dog Lizzie died in October. She had been getting Milo’s chicken jerky for sometime. One night she started acting like she was sick. She just laid around. She was gone 2 hours later. I still miss her very much. She had been to vets not long before that and she was healthy.

    My little 3 pd dog has also got sick and is still recovering from these treats. I have taken him to the Vet 2x and he also has signs of kidney trouble. After 2 blood tests from last yr and last week he still shows high in ALT/GGT. I trusted in this company from reading the package and not knowing anything about the problems or it being made from China since all the other products from this company are made in the USA. Shame on you for not posting anything about the product on the shelf so consumers could make up their own minds! I would of never put my poor little dog thru all this sickness! I also want to know how to make this company pay! Please e-mail!

    HOW DO I GET IN ON A CLASS ACTION LAWSUIT? My 6 year old dog survived after being diagnosed with kidney failure (6/12) after eating Milos Chicken Jerky Treats. $1500+ dollars, vets & specialists and hospital stays, and LOTS of tears later she is ok. FDA did nothing. Want to be involved in a class action. PLEASE HELP. Thanks.

    We started giving kiwi (Pom) Milo’s kitchen chicken jerky treats in Sept. and had to put her down feb. 20th. 2012. These people need to be stopped!
